SO AFTER HURRICANE BERYL BARRELED THROUGH AND WE WERE ONCE AGAIN WITHOUT POWER, JOHN AND I HAD A SERIOUS CONVERSATION ABOUT WHAT SHOULD WE BE DOING? SHOULD WE BE INSTALLING A GENERATOR? SHOULD WE BE INSTALLING SOLAR? AND ULTIMATELY, WE DECIDED THAT WE WERE GOING TO GO THE SOLAR ROUTE. NOW, WE DIDN'T DO THAT VERY LIGHTLY BECAUSE WE KNOW WE'RE IN A HISTORIC DISTRICT. SO WE DID A LOT OF RESEARCH NOT ONLY ON THE COMPANIES FOR SOLAR RESEARCH, BUT ON POTENTIAL RESTRICTIONS THAT CAN HAPPEN IN A HISTORIC DISTRICT AND WHAT WE FOUND OUT WAS THAT IN 2021, TEXAS PASSED A LAW CALLED THE SOLAR CONSUMER PROTECTION ACT, WHICH MEANS IF YOU LIVE IN A HISTORIC DISTRICT. THE MUNICIPALITY IN WHICH YOU LIVE CAN'T PUT ANY ADDITIONAL RESTRAINTS UPON YOU INSTALLING A SOLAR SYSTEM ON YOUR HOME THAN THEY DO ON ANY OTHER HOME WITHIN THAT MUNICIPALITY. [00:10:01] THE LANGUAGE IS VERY PLAIN, AND IT SAYS A MUNICIPALITY MAY NOT PROHIBIT OR RESTRICT THE INSTALLATION OF A SOLAR DEVICE BY A RESIDENTIAL OR SMALL COMMERCIAL CUSTOMER, EXCEPT TO THE EXTENT THAT THE PROPERTY'S OWNERS ASSOCIATION MAY PROHIBIT THE INSTALLATION UNDER CERTAIN SECTIONS, WHICH IS ESSENTIALLY SAYING IF YOU LIVE IN AN HOA, THERE'S CERTAIN HOA CONCERNS WITH REGARDING COMMON GROUND AND NOT INFRINGING ON SOMEBODY ELSE'S. BUT OTHER THAN THAT, WHATEVER RESTRICTIONS THERE ARE FOR SOLAR PANEL INSTALLATIONS HAVE TO BE UNIFORMLY ADHERED TO BY ALL PROPERTY OWNERS, REGARDLESS OF WHERE THAT HOME IS SITUATED. SO WE WERE ENCOURAGED BY THAT BECAUSE WE ANTICIPATED THAT THERE WOULD BE NO ISSUE WITH THE INSTALLATION OF THE SOLAR PANELS. BUT THE CITY STAFF HAS COME BACK AND SAID THEY DON'T LIKE THE FACT THAT SOLAR PANELS WILL BE VISIBLE FROM THE STREET. NOT THAT THERE'S A SAFETY ISSUE, NOT THAT WE'RE INSTALLING SOMETHING INAPPROPRIATE SIMPLY BY THE FACT THAT YOU CAN SEE THE SOLAR PANELS FROM THE STREET. I DON'T KNOW THAT THAT'S A LEGITIMATE CAUSE TO ASK US TO CHANGE OUR INSTALLATION PANEL, BECAUSE THIS SECTION OF THE ROOF REPRESENTS 46% OF THE PRODUCTION OF THE ARRAY. AND THE REASON FOR THAT IS IT IS A SOUTH FACING, AND IT'S NOT IMPEDED BY ANY TREES OR OTHER BUILDINGS. THERE'S NOT VERY MANY HOMES IN THE HISTORIC DISTRICT THAT HAVE SOLAR PANELS YET, BUT WITHIN TWO MINUTES OF MY HOME, THERE'S THREE VERY PROMINENT ONES. THE FIRST ONE IS AT 25TH AND AVENUE O, WHICH IS THE FIRST PHOTO IN YOUR LITTLE HANDOUT. YOU CAN SEE THAT THERE ARE SOLAR PANELS ON THE FRONT HALF OF THIS HOUSE ON THE SOUTH FACING SIDE, WHICH ARE CLEARLY VISIBLE FROM THE STREET. BECAUSE I TOOK THIS PICTURE FROM ACROSS THE STREET IN MY CAR AND I TOOK A SECOND PHOTO OF THAT SO YOU COULD SEE THE NEXT HOUSE DOWN THE STREET IS 1520 25TH STREET. AGAIN, THESE PANELS ARE PLACED ON THE SOUTH FACING SIDE OF THE ROOF, ON THE FRONT HALF OF THE ROOF, AND THEY'RE CLEARLY VISIBLE FROM THE STREET. AND NOT ONLY ARE THEY VISIBLE FROM THE STREET, THEY ARE BLACK PANELS ON A TAN ROOF. OUR HOME HAS A GREEN BLACK ROOF, AND WE ARE JUST COMPLETING INSTALLATION OF A NEW ROOF PRIOR TO THE INSTALLATION OF THE SOLAR PANELS, WHICH WILL BE THE EXACT SAME COLOR AS YOU SEE IN THIS PICTURE. SO THE BLACK SOLAR PANELS WILL BE LESS OBSERVANT ON OUR HOUSE THAN THESE BLACK PANELS ARE. I DON'T BELIEVE THAT, SIMPLY BECAUSE YOU CAN SEE THE PANELS FROM THE STREET THAT SOMEBODY'S GOING TO FALL ON THE SIDEWALK CRINGING AT THE NECK, SAYING, OH MY GOD, THEY'VE RUINED THIS HISTORIC HOME. NOW THIS WOULD REQUIRE US TO SEPARATE OUR ARRAY, WHICH WOULD MEAN TRENCHING UNDER THE ENTIRE LENGTH FROM THE GARAGE TO THE HOUSE, TO RECONNECT IT TO WHERE ALL THE ELECTRICAL WORK IS, WHICH IS ON OUR HOUSE.
