PART OF WHAT'S PROPOSED FOR ADOPTION IN TONIGHT'S ORDINANCE IS MITIGATION FOR OTHER PARTS OF THE PLAN, ADOPTED IN ORDINANCES FROM MAY AND OCTOBER OF 2023, WITH THE FULL SCOPE OF THE PLAN BEING PIECEMEALED OUT ACROSS ORDINANCES IS VERY DIFFICULT FOR THE PUBLIC TO FOLLOW AND UNDERSTAND THE PLAN AS A WHOLE.
TEXAS ADMINISTRATIVE CODE TITLE 31, PART ONE, CHAPTER 15, SUBCHAPTER A, SECTION 15.7 H, REQUIRES THAT A LOCAL GOVERNMENT REGULATE PEDESTRIAN OR VEHICULAR BEACH ACCESS, TRAFFIC, AND PARKING ON THE BEACH ONLY IN A MANNER THAT PRESERVES OR ENHANCES EXISTING PUBLIC RIGHT TO USE AND HAVE ACCESS TO AND FROM THE BEACH.

IF SO, THE PLAN WOULD NOT BE CONSISTENT WITH TEXAS LAW.

SO WE HAD THAT REQUEST OF RESTRICTING VEHICLES IN THIS AREA.
THE ONLY VEHICLES ALLOWED IN THIS AREA ARE BECAUSE OF THE RESTRICTED USE AREA.
SO THE ONLY WAY THAT WE CAN RESTRICT THE VEHICLES IN THIS AREA IS TO REMOVE THAT.
AND THAT'S WHY WE ARE RELOCATING IT TO OTHER AREAS TO ALLOW THAT, TO ALLOW ADA FISHERMEN, PEOPLE LAUNCHING NON-MOTORIZED VESSELS TO HAVE ACCESS TO THE WATER.
