BUT LET'S HAVE A ROLL CALL, PLEASE NELLIE.
RAY, THANK YOU FOR BEING HERE.
THANK YOU MAYOR. A THANKSGIVING PRAYER AS WE PREPARE FOR THANKSGIVING HOLIDAYS.
WE'RE REMINDED OF BACK IN THE 1950S.
SOME OF US MIGHT REMEMBER THE THESE WORDS WRITTEN BY WOODY GUTHRIE.
THIS LAND IS YOUR LAND, THIS LAND IS MY LAND FROM THE NEW YORK ISLANDS TO THE REDWOOD FOREST, FROM THE FROM CALIFORNIA TO THE NEW YORK ISLANDS, FROM THE REDWOOD FOREST TO THE GULF STREAM WATERS.
THIS LAND WAS MADE FOR YOU AND ME.
WE'RE ALSO BLESSED TO BE A PART OF SUCH A GREAT LAND, A GREAT NATION.
AND OUR PRAYER BEGINS FROM PSALM 107.
OH GIVE THANKS TO THE LORD, FOR HE IS GOOD.
LET THE REDEEMED OF THE LORD SAY THIS.
THOSE HE GATHERED FROM THE LANDS, FROM THE EAST AND FROM THE WEST, FROM THE NORTH AND THE SOUTH.
SOME WANDERED IN DESERT WASTELANDS, FINDING NO WAY TO A CITY WHERE THEY COULD SETTLE.
THEY WERE HUNGRY AND THIRSTY, AND THEIR LIVES EBBED AWAY.
THEN THEY CRIED OUT TO THE LORD IN THEIR TROUBLE, AND HE DELIVERED THEM FROM THEIR DISTRESS.
HE LED THEM BY THE STRAIGHT WAY TO A CITY WHERE THEY COULD SETTLE.
LET THEM GIVE THANKS TO THE LORD FOR HIS UNFAILING LOVE AND HIS WONDERFUL DEEDS.
WE GIVE YOU THANKS FOR OUR MAYOR, DR.
CRAIG BROWN, FOR OUR CITY MANAGER, BRIAN MAXWELL, AND WE GIVE THANKS FOR EACH ELECTED OFFICIAL OF OUR CITY COUNCIL FOR THEIR DEDICATION AND SERVING THE WELL-BEING OF THE CITIZENS OF GALVESTON.
WE ALL ARE BLESSED TO LIVE IN SUCH A GREAT LAND THAT BELIEVES IN THE WELL-BEING OF EACH INDIVIDUAL, CREATED IN THE IMAGE AND LIKENESS OF GOD.
RAY. LET'S HAVE THE PLEDGE OF ALLEGIANCE, PLEASE.
COUNCIL MEMBERS, ARE THERE ANY CONFLICTS OF INTEREST THAT ANY COUNCIL MEMBER WOULD LIKE TO DECLARE? HEARING NO RESPONSE.
SOME HOUSEKEEPING CHORES, BEFORE WE GET INTO OUR ORDER OF BUSINESS.
ITEM EIGHT C ON OUR AGENDA HAS BEEN DEFERRED.
WE WILL NOT BE SEEKING ANY ACTION OR HAVING ANY ACTION ON THOSE TWO ITEMS.
[00:05:01]
THEY WILL PROBABLY COME BACK ON OUR DECEMBER 14TH AGENDA FOR CITY COUNCIL.VERY GOOD. COULD YOU READ ITEM SIX PLEASE, MA'AM? ITEM SIX, PRESENTATIONS REPORTS OF COUNCIL OFFICER BOARDS AND CITY MANAGER.
[6. PRESENTATIONS/REPORTS OF COUNCIL, OFFICER BOARDS, AND CITY MANAGER]
SIX A, PURSUANT TO TEXAS GOVERNMENT CODE, SECTION 551.0415, THE CITY COUNCIL MAY REPORT ON ANY OF THE FOLLOWING ITEMS. WE HAVE A NUMBER OF ANNOUNCEMENTS TO MAKE, BUT I WOULD BLESS YOU.I WOULD LIKE TO START THIS OFF TODAY.
FIRST OF ALL, WE NORMALLY DO THIS TOWARDS THE END OF THE MEETING AND WE CAN DO THIS.
BUT SINCE EVERYONE IS HERE, I WANT TO WISH EVERYONE A WONDERFUL THANKSGIVING AND GLAD TO HOPE YOU AND YOURS HAVE A WONDERFUL HOLIDAYS THIS COMING THANKSGIVING.
WHEN WE THINK OF THANKSGIVING, WE GIVE THANKS FOR MANY THINGS AND I WOULD LIKE TO ALSO GIVE THANKS TO A FAMILY HERE ON THE ISLAND THAT HAS BEEN REALLY PART OF GALVESTON AND THAT IS THE MOODY FAMILY.
RECENTLY, BOBBY L MOODY PASSED AWAY AND I DID NOT HAVE THE PRIVILEGE OF KNOWING MR. MOODY PERSONALLY, BUT WHAT AN ICON FOR GALVESTON.
HE WAS RESPONSIBLE FOR THE ECONOMIC DEVELOPMENT OF THIS ISLAND IN SO MANY DIFFERENT WAYS.
HE WAS BORN IN 1935 AND BECAME A INDIVIDUAL HERE IN THE ISLAND THAT LOVED THIS ISLAND AND WAS BEHIND THE SCENES IN SO MANY WAYS FOR THE DEVELOPMENT OF THIS ISLAND.
THERE WERE ONLY FOUR, BUT THE FIFTH CHILD WAS THE CITY OF GALVESTON THAT MR. MOODY LOVED DEARLY.
IN 1905, HE FOUNDED AMERICAN NATIONAL INSURANCE COMPANY, WHICH GREW INTO THE LARGEST LIFE INSURANCE COMPANY IN THE WORLD. AND TO QUOTE A QUOTE FROM VIC PEARSON, WHO WORKED WITH MR. MOODY FOR YEARS, MR. PEARSON SAID THAT EVERYONE THOUGHT THAT HIS TALENTS WOULD REALLY HIS BUSINESS SAVVY AND HIS ACUMEN IN BUSINESS, BUT REALLY WHAT IT WAS IS HIS LOVE FOR PEOPLE AND HELPING PEOPLE.
IN 1980, HIS SON WAS INJURED IN A TRAFFIC ACCIDENT AND HAD TO HAVE CARE THROUGHOUT HIS LIFE.
AND MR. MOODY STARTED TO TURN HIS ATTENTION AND HIS FUNDING TOWARDS HELPING OTHERS.
THAT WAS THE IMPETUS FOR MOODY GARDENS, AND OVER THE YEARS, MR. MOODY AND THAT FAMILY HAVE DONATED OVER $2 BILLION AROUND THE STATE OF TEXAS.
SO, ON BEHALF OF THE CITY OF GALVESTON, I WOULD LIKE TO FORMALLY EXTEND OUR CONDOLENCES AND SYMPATHIES TO THE MOODY FAMILY. ALSO, I WOULD LIKE TO SAY ONE OTHER THING AND MORE OF A NOTE OF CONGRATULATIONS. I WOULD LIKE TO CONGRATULATE KIMBERLY DANESI FOR THOSE THAT HAVE BEEN FOLLOWING THIS.
MS. DANESI WAS APPOINTED THE CEO OF THE PARK BOARD.
THAT HAS BEEN A TOPIC OF DISCUSSION HERE AND WITH CITY COUNCIL FOR MANY, MANY MONTHS GOING ON NOW.
AND WE'RE LOOKING FORWARD TO HAVING MS. DANESI AS THE CEO OF THE PARK BOARD.
I'M GOING TO MOVE NOW AND TURN THIS OVER TO COUNCIL MEMBER ROBB.
I WOULD LIKE TO HAVE JOIN US UP HERE, OUR VISITORS FROM NIIGATA, JAPAN, WHO IS ONE OF OUR SISTER CITIES, AND WE HAVE A PROCLAMATION FROM THE CITY.
WHEREAS NIIGATA, JAPAN AND GALVESTON, TEXAS BECAME SISTER CITIES ON JANUARY 28TH, 1965 AND IF I'M NOT MISTAKEN, WE'RE YOUR OLDEST SISTER CITY.
BUT WE ALL STAY ETERNALLY YOUNG.
[00:10:02]
AND WHEREAS OUR CITIES, OUR CITIES HAVE CONTINUED TO NOURISH THE FRIENDSHIP THAT EXISTS THROUGH VARIOUS ACTIVITIES AND PROJECTS.WHEREAS THE CITY OF GALVESTON IS HONORED TO HAVE THE NIIGATA CITY DELEGATES VISITING OUR BEAUTIFUL ISLAND, WHEREAS WE HOPE OUR CONTINUOUS INTERACTION AND UNDERSTANDING OF BOTH CITIES WILL MAKE OUR FRIENDSHIP SPECIAL FOR MANY YEARS TO COME.
AND THEREFORE, WE, THE MAYOR AND THE CITY COUNCIL, DECLARE NOVEMBER 16TH, 2023 AS NIIGATA JAPAN DAY.
SO. [APPLAUSE] AND WITH THAT, WE WOULD LIKE FOR YOU TO BRING THIS BACK TO YOUR MAYOR OR WHOMEVER IS APPROPRIATE.
IT'S HEAVY. NOW YOU CAN GET IN ANY DOOR YOU WANT.
THANK YOU. SO I'M GOING TO HAVE YOU COME UP AND INTRODUCE AT LEAST ONE PERSON.
BUT HAVE YOU INTRODUCED ALL OF YOURSELVES? HELLO. I'M RIEKO ISHIZUKA, THE SECRETARY OF NIIGATA GALVESTON COMMITTEE, AND ACCOMPANY MR. KOZUKI KAZUHITO AND MR. NOGUCHI MOTOKI.
THEY ARE THE MEMBERS OF NIIGATA TAIGA DRAMA REVIVAL PROJECT, AND THEY HAVE BEEN WORKING FOR THE REVIVAL OF THE TAIGA DRAMA, THE JAPANESE TRADITIONAL TOY BASED ON THE MACHI IN NIIGATA CITY.
AND ALSO THE TAIGA DRAMA IS A KIND OF GO BETWEEN NIIGATA AND GALVESTON.
AND THANK YOU FOR HAVING US, AND I WOULD LIKE TO EXPRESS OUR BEST GRATITUDE AND RESPECT TO SISTER CITIES COMMITTEE, CHAIRED BY LEAH TUTEN AND VICE CHAIR JOE CAPPADONA AND ALL THE MEMBERS OF COMMITTEE FOR HAVING US AND FOR THEIR CONTRIBUTION, ENERGY, PASSION AND TIME TO PROMOTE THE FRIENDSHIP BETWEEN US.
THANK YOU. [APPLAUSE] AND I HAVE ONE MORE, ONE MORE PRESENT THAT IS ACTUALLY FROM MY ROTARY CLUB THAT I WAS SO HONORED TO HAVE YOU ALL JOIN US.
AND I THINK. THAT'S TURNED AROUND AND LOOKED A PICTURE.
YEAH. AND I JUST WANT TO SAY YESTERDAY WE, I WAS MY PLEASURE TO BRING THE, OUR VISITORS AROUND TOWN. AND I WANT TO THANK THE FIRE COMPANY.
THEY GOT TO TAKE A RIDE IN A FIRE TRUCK EVEN IF WE JUST WENT AROUND THE CORNER, IT WAS VERY FUN.
FIRST TIME I HAD EVER RIDDEN IN ONE ALSO.
AND THEN WE ALSO GOT TO RIDE IN A POLICE CAR AND WE HAD THE OFFICIAL POLICE OFFICER.
WE ALL PLAYED PRISONERS AND WE ALSO WENT AND VISITED KATY SEAFOOD HOUSE.
I MEAN SEAFOOD STORE, WHICH WAS VERY ENJOYABLE.
BUT ANYWAY, WE WELCOME YOU AND WE ARE SO HAPPY TO HAVE YOU HERE AND I WILL LEAVE YOU WITH THIS BAG.
THANK YOU. THANK YOU VERY MUCH.
THANK YOU VERY MUCH. WE HAVE QUITE AN ACTIVE SISTER CITIES PROGRAM COMMITTEE HERE AT THE CITY, AND IT BY ALL MEANS, YES, ME.
[00:15:07]
BECAUSE I REALLY DO WANT TO THANK THE SISTER CITY COMMITTEE, OF WHICH I AM THE EX OFFICIO, AND I CALL MYSELF THE WORST EX OFFICIO EVER.BUT I WOULD ALSO LIKE TO THANK JAY CARNES OF CARNES FUNERAL HOME.
HE HAS GRACIOUSLY DONATED FOUR FOOTBALL TICKETS.
SO THEY'RE GOING TO THE TEXAS GAME, WHICH THAT WAS VERY MUCH ONE OF THEIR WISH LIST.
SO THEY HAVE GREAT SEATS AND A PARKING PASS.
SO THANK YOU, JAY, FOR DONATING THAT.
THIS COMMITTEE HERE AT THE CITY HAS BEEN IN EXISTENCE A LONG TIME AND FOR MANY YEARS IT WAS SOME A COMMITTEE THAT WE REALLY DIDN'T HEAR A LOT FROM.
AND RECENTLY THIS COMMITTEE HAS BECOME EXTREMELY ACTIVE.
IF YOU'RE DRIVING AROUND THE CITY AT 69TH IN STUART ROAD, WE HAVE FLAGS INSTALLED HONORING ALL OF OUR SISTER CITIES, ONE IN SPAIN, ONE IN NORWAY, IN VERACRUZ, MEXICO ALSO, SO VERY GLAD TO WELCOME THOSE INDIVIDUALS FROM NIIGATA, JAPAN AND LEAH THANK ALL YOUR COMMITTEE MEMBERS.

IS COUNCILWOMAN LEWIS STILL WITH US? THERE SHE IS. OKAY.
DANIEL OR CATHERINE, WILL YOU BE INTRODUCING THIS? ALL RIGHT. STANDING IN FOR DANIEL TODAY.
THE BUILDING OPENED DURING AN ERA OF SEGREGATION AND SERVED PRIMARILY AFRICAN AMERICANS, AND INCLUDED AFRICAN-AMERICAN BUSINESSES WHO PROVIDED GOODS AND SERVICES TO THE SURROUNDING OLD CENTRAL AFRICAN-AMERICAN NEIGHBORHOOD.
STAR STATE ENGINE HOUSE NUMBER THREE, WHERE THE CITY'S FIRST AFRICAN-AMERICAN FIREFIGHTERS WERE HIRED IN 1957, AS WELL AS THREE BLACK INTERNATIONAL LONGSHOREMEN ASSOCIATION CHAPTERS.
THE CURRENT OWNER AND TENANTS CONTINUE THE TRADITION AND ASSOCIATION WITH GALVESTON'S AFRICAN-AMERICAN COMMUNITY, WHICH MAKES THE BUILDING HISTORICALLY AND CULTURALLY IMPORTANT . LANDMARK COMMISSION, PLANNING COMMISSION AND STAFF ARE RECOMMENDING APPROVAL.
THANK YOU VERY MUCH, CATHERINE.
COUNCIL, ANY QUESTIONS FOR MISS GORMAN THAT YOU MAY HAVE? IT IS 5:19 P.M., I'M GOING TO OPEN THE PUBLIC HEARING ON THIS PARTICULAR ITEM.
I THINK WE HAVE MISS JACKSON HERE.
MISS JACKSON, WOULD YOU LIKE TO COME FORWARD AND SAY ANYTHING? COUNCIL TO THE MAYOR.
I JUST WANT TO SAY WHAT A DAY.
WHAT A DAY. I JUST WANT TO SAY I WISH Y'ALL WOULD MAKE THIS GO THROUGH, BECAUSE IT MEANS SO MUCH TO ME AND MY COMMUNITY. IT'S JUST NOT A CLUB TO ME, Y'ALL.
[00:20:03]
IT'S A COMMUNITY HALL TO ME.AND IF I CAN BUILD IT UP, I WILL.
WE DO A BACK TO SCHOOL THERE FOR THE KIDS.
MOSTLY EVERYTHING, THE HOLIDAYS WE DO LIKE THIS MONDAY WE'LL BE FEEDING EVERYBODY.
WE FEED THE POLICE DEPARTMENT.
WE FEED THE CITY, WE FEED THE HOMELESS.
SO THIS IS WHAT MAKES ME KEEP THIS BUILDING GOING.
AND, YOU KNOW, PERCY [INAUDIBLE] HAD FAITH IN ME TO KEEP IT GOING.
SO THIS IS WHAT I'M DOING HERE AND FOR MY COMMUNITY IN GALVESTON.
AND I WOULD APPRECIATE IT IF Y'ALL MAKE THIS HISTORICAL.
THANK YOU VERY MUCH, MISS JACKSON.
ANYONE ELSE WOULD LIKE TO MAKE A COMMENT ON THIS PARTICULAR ITEM? COME FORWARD. YES, MA'AM.
GLAD TO HAVE ANYONE COME FORWARD AS YOU SEQUENTIALLY AS WE GO THROUGH THIS.
ANYONE THAT WOULD LIKE TO SPEAK? YES, MA'AM. [INAUDIBLE] I MEAN, THE JUDGE.
AND I'LL SAY CLUB 68 IS WAY MORE THAN THE CLUB.
LIKE SHE SAID, THEY GIVE FUNERALS, THEY GIVE BACK TO SCHOOL DRIVES, WE FEED THE HUNGRY.
YOU KNOW, EVEN WHEN I GO IN THERE, YOU KNOW, I PRAY SOME SOULS AND GOD SAVED UP IN THERE.
ROSLYN WORKS HARD, YOU KNOW, AND FOR THE COMMUNITY.
I KNOW IF GOD'S WILL, NO MAN CAN TAKE IT AWAY.
SO I LOVE YOU ALL AND THANK YOU ALL SO MUCH.
RIGHT, LET ME SAY WELCOME TO Y'ALL AS WELL.
MY NAME IS ELIJAH SMITH, AND I JUST WANT TO SHARE THAT FACT THAT I'VE BEEN IN GALVESTON PRETTY MUCH ALL MY LIFE AND BEEN A PART OF 68 AS WELL. AND WE EVERYTHING THAT'S BEEN SHARED, BEEN SHARED WITH ALL THE DIFFERENT THINGS WE DO.
BUT I WOULD LIKE Y'ALL FOR Y'ALL TO THINK ABOUT.
IF Y'ALL TAKE IT FROM US, IT'S TAKING SOME DETRIMENTAL TO THE TO THE CITY OF GALVESTON.
YOU KNOW THAT HARD OVER THERE? AND WE APPRECIATE Y'ALL.
APPRECIATE. ANYONE ELSE COME FORWARD? SIR? HELLO.
HELLO, EVERYBODY. MY NAME IS FRANKLIN BARRY.
I JUST MOVED BACK HOME MAYBE THREE YEARS AGO.
AND I OWN THE SALON, NOCHE BERRY SALON THAT RESIDES INSIDE THE BUILDING WHERE MS. JACKSON HAS THIS CLUB 68.
IT'S BEEN A MAJOR, MAJOR RESOURCE TO THE COMMUNITY.
MYSELF. I'VE BEEN ABLE TO PUT ON A BACK TO SCHOOL DRIVE EVERY YEAR THAT I'VE BEEN BACK HOME, WHERE WE'VE SERVICED OVER 300 CHILDREN, WE'VE PROVIDED BACKPACKS AND SCHOOL SUPPLIES. MYSELF, ROSLYN DOES A SEPARATE ONE, BUT I DO ONE.
WE ALSO GIVE AWAY FREE HAIRCUTS AND FREE HAIRSTYLES FOR THE YOUNG LADIES.
WE GIVE THEM UNIFORMS AND JUST PREPARE THEM FOR SCHOOL.
NOT ONLY DO WE DO THAT, I HOST A IT'S CALLED SOUL FOOD SESSIONS WHERE WE CONNECT THE COMMUNITY WITH MENTAL HEALTH RESOURCES, AND THAT'S BEEN VERY HELPFUL BECAUSE WE DIDN'T KNOW SO MANY PEOPLE NEEDED THAT UNTIL WE STARTED IT.
AND WE ALSO HAVE POETRY NIGHT, WHICH SOME PEOPLE GET TO COME OUT AND EXPRESS THEMSELVES.
SO THIS IS JUST NOT A BUILDING.
THE CLUB HAS BEEN A LOT TO A LOT OF PEOPLE EVEN SINCE I'VE BEEN BACK FOR THREE YEARS.
SO IF YOU CAN FIND IT IN YOUR HEART TO MAKE IT HISTORICAL, WE WOULD APPRECIATE IT.
THANK YOU VERY MUCH. YOU'RE WELCOME.
HAVE A GOOD EVENING. GOOD EVENING, EVERYBODY.
I'M BLESSED TO OWN OFFICE THAT I NAMED AFTER MY GRANDMOTHER.
AND SHE HAD A RESTAURANT IN THE IN THE 50S.
AND SHE'S STEALING US THE FEET TO THE SOUL AND PUT A SMILE ON HER FACES ALL THE TO THE BELLY.
AND BY WATCHING THEM AND LISTENING TO THEM, HOW THEY COOK AND TREAT THE PEOPLE.
NOW I'M BLESSED TO, TO DO, TO GIVE BACK THE SAME THING.
AND THIS BUILDING IS A WHOLE LOT TO THE KIDS AND EVERYTHING ELSE.
THEY CALL ME THE CHECK IN SPOT BECAUSE I KNOW PRETTY MUCH EVERYBODY ELSE AND EVERYTHING GOES.
[00:25:03]
AND I CAN TELL YOU, STARTING WHEN WE WERE LITTLE BACK THEN, AS KIDS, WE HAD TO GET IN THE BACK ROOM.I CAN'T WAIT TILL WE GET GROWN SO WE CAN GO TO THE PARADISE AND EVERYTHING ELSE.
AND WHEN SHE DIDN'T STEAL THIS A LONG TIME AGO.
BUT I WILL HAVE TO MAKE IT A HISTORICAL AND EVERYTHING AND BLESSING I'M WILLING TO FEED ALL Y'ALL.
SO COME ON. THANK YOU VERY MUCH.
ANYONE ELSE WOULD LIKE TO SAY A FEW WORDS? HI. HI.
I'M A GALVESTONIANS WENT TO URSULINE ACADEMY, GRADUATED FROM O'CONNELL.
BUT IT'S SOMEWHERE TO GO TO SEE PEOPLE FACES.
MY FATHER WORKED AT THE FALSTAFF BUILDING.
MR. CLARE MILBURN, WHO'S PASSED AWAY, TALKS ABOUT IT.
SLOWLY, SLOWLY, SLOWLY AND SO, SO SOMEWHERE TO DANCE.
AND IT'S CHEAPER TO DANCE AND TO PAY FOR A GYM MEMBERSHIP.
SO PLEASE, IF YOU CAN KEEP IT OPEN.
THANK YOU. ANYONE ELSE WOULD LIKE TO SAY A FEW WORDS ON THIS? MR. MILLER? GOOD EVENING.
AND ALL THIS ABOUT THE BUILDING.
BUT IT WAS IN THE NEIGHBORHOOD I LIVED IN BAYVIEW.
MY OLDEST SON WAS BURIED IN BAYVIEW.
SO ALL OF THE THINGS THEY CAN TELL YOU ABOUT THIS BUILDING.
I LIVED THE FIRST CLUB WAS THERE.
AND IT'S NOT ABOUT THE CLUB 68.
AND THEN AFTER THAT, CLUB 68 IS IMPORTANT TO ME, BUT IT'S ABOUT THE BUILDING.
EVERYTHING WE'VE HAD, EVERYTHING WE HAVE IS JUST ABOUT GONE.
AND WHAT THEY SAY THEY GIVE AND THEY DO ALL THESE THINGS.
THEY DO THAT. BUT WE DON'T HAVE NO PLACE ELSE.
AND SINCE THEY GOT THERE, THEY APPRECIATE WHAT THE BUILDING IS FOR AND WHAT IT STANDS FOR.
MOST OF Y'ALL KNOW ME, I DON'T I DON'T GET BEHIND.
I DON'T SAY ANYTHING THAT I DON'T LIKE AND I DON'T KNOW IF I DON'T LIKE YOU.
I'LL TELL YOU I DON'T LIKE YOU, YOU KNOW THAT.
BUT I LIKE WHAT THIS BUILDING STANDS FOR.
IT HAS EVERYTHING THAT IT NEEDS TO HAVE EXCEPT YOUR VOTE.
I'M COUNTING ON THAT. THANK YOU.
VERY GOOD. ANY OTHER COMMENTS ON THIS? BEFORE WE CLOSE THE PUBLIC HEARING, I WANT TO SAY, AND THIS IS NOT A DETRIMENT TO ANY OF THE GENTLEMEN THAT SPOKE, BUT THESE ARE THE MOST WELL DRESSED WOMEN THAT I'VE EVER HAD. COME UP AND SPEAK FOR THIS.
YES, I WILL MAKE A MOTION THAT WE APPROVE THIS.
JUST ONE SECOND, SHARON, TO BE ON THE SCREEN.
LET'S LET'S GET YOU ON THE SCREEN.
I MAKE A MOTION THAT WE APPROVE THIS APPLICATION FOR THIS HISTORICAL MARKER AT CLUB 68.
I'LL SECOND. WE HAVE A MOTION.
I CAN'T WAIT TO GO THERE AND CHECK OUT THE DANCING.
I'M GOING AND GET THE FREE HAIRCUT, BUT.
VERY GOOD. WE HAVE A MOTION FOR APPROVAL AND A SECOND ON THIS PARTICULAR ITEM.
ALL THOSE IN FAVOR, PLEASE RAISE YOUR HAND.
[00:30:03]
AMEN. THAT IS UNANIMOUS.CONGRATULATIONS. YOU'RE WELCOME.
MAYOR. DO YOU MIND IF WE TAKE A MINUTE AND DO THE PRESENTATION OF THE PLAQUE? YES. CATHERINE, I WANT TO SAY YOUR HAIR LOOKS GREAT.
I JUST WANT TO SAY THANK EACH ONE OF Y'ALL.
WE DON'T GET PAID. BUT THIS IS PAYMENT ENOUGH.
THIS IS A WONDERFUL, WONDERFUL THING.
[8.B. Consider For Approval An Ordinance Of The City Of Galveston, Texas, Amending The 2015 Galveston Land Development Regulations, By Amending “Article 2: Uses And Supplemental Standards, Section 2.602 In Order To Modify Requirements For Certain Uses To Provide Permanent Buildings And Restroom Facilities; Planning Case Number 23ZA-004; Making Various Findings And Provisions Related To The Subject. (C. Gorman)]
BY AMENDING ARTICLE TWO USES AND SUPPLEMENTAL STANDARDS.PLANNING CASE NUMBER 23-004 MAKING VARIOUS FINDINGS AND PROVISIONS RELATED TO THE SUBJECT.
STAFF MOSTLY AGREES WITH THE APPLICANT'S SUBMITTAL BUT HAS PROPOSED SOME CHANGES.
PLANNING COMMISSION HAS REVIEWED AND AGREED WITH THE CHANGES PROPOSED BY STAFF, SO STAFF'S RECOMMENDATION IS INCLUDED IN THE ORDINANCE, PLANNING COMMISSION AND STAFF BOTH ARE RECOMMENDING APPROVAL OF STAFF'S RECOMMENDATION.
IS THAT CORRECT OR IS RIGHT? SO THE APPLICANT HAS MADE A PROPOSAL WHICH IS TO EXEMPT SOME USES FROM HAVING TO HAVE A PERMANENT BUILDING WITH A BATHROOM.
THE CEMETERY OFTEN HAS ACCESSORY BUILDINGS LIKE CHAPELS.
UM, AND THEN IN THE SECOND SET OF PROPOSED CHANGES.
THERE'S JUST SOME KIND OF LANGUAGE DIFFERENCES FROM THE APPLICANT'S PROPOSAL.
AND AT PLANNING COMMISSION, WE TALKED ABOUT THESE USES IN THE BATHROOM SECTION.
SO YOU'LL BE SEEING ANOTHER COMPANION CASE TO THIS PROBABLY IN JANUARY.
THAT'S WHAT'S IN THE ORDINANCE.
ALL RIGHT, THANK YOU VERY MUCH.
ANY QUESTIONS FOR MS. GORMAN COUNCIL? VERY GOOD. IT IS 5:33 P.M., I'M GOING TO OPEN THE PUBLIC HEARING ON THIS ITEM.
IS THERE ANYONE IN THE AUDIENCE THAT WOULD LIKE TO MAKE A COMMENT ON THIS? MR. GERTNER. HOW ARE YOU, SIR? GOOD EVENING, COUNCIL MEMBERS.
I'M MIKE GERTNER, I'M THE APPLICANT.

ANY QUESTIONS FOR MR. GERTNER COUNCIL? THANK YOU MIKE.
ANY OTHER COMMENTS ON THIS PARTICULAR ITEM? IT'S 5:34 P.M., I'M GOING TO CLOSE THE PUBLIC HEARING ON ITEM EIGHT B, BRING THAT BACK TO COUNCIL.
I WANT TO NOTE THAT MISS LEWIS IS NOT WITH US RIGHT NOW.
MISS LEWIS IS NOW LEFT THE SCREEN.
SHE DROPPED OFF. SHE'S NOT ON THE CALL ANYMORE.
THAT MISS LEWIS IS NO LONGER IN ATTENDANCE AT THE COUNCIL HERE.
[00:35:04]
VERY GOOD. IT IS BACK NOW TO COUNCIL FOR ACTION.I'LL MAKE A MOTION TO APPROVE WITH STAFF RECOMMENDATIONS.
I WOULD SECOND, I HAVE A MOTION FOR APPROVAL.
COUNCILMAN LISTOWSKI, SECONDED BY COUNCILMAN COLLINS.
ANY DISCUSSION? ALL THOSE IN FAVOR? THAT IS UNANIMOUS OF THOSE HERE.
ITEM EIGHT C, AS I MENTIONED, HAS BEEN DEFERRED.
AND WE'RE GOING TO MOVE TO ITEM EIGHT D PLEASE.
[8.D. Change of Zoning for Proposed Roseate Beach Development - Vacant Tracts located East And West Of Pabst Road, North Of The Bermuda Beach Subdivision, West Of 11 Mile Road, And South Of San Luis Pass Road/FM 3005.]

CATHERINE. SO THE CURRENT ZONING CONFIGURATION ON THE SUBJECT PROPERTIES, WHICH CONSISTS OF MULTIPLE DIFFERENT ZONES, WAS PUT IN PLACE DURING THE 2015 CITYWIDE REZONING EFFORT, WHICH WAS ASSOCIATED WITH THE ADOPTION OF THE LAND DEVELOPMENT REGULATIONS.
STAFF FINDS THE REMOVAL OF THE OVERLAY IS APPROPRIATE.
STAFF AND THE PLANNING COMMISSION ARE RECOMMENDING APPROVAL.
GORMAN COUNCIL? IT IS 5:37 P.M..
I'M GOING TO OPEN THE PUBLIC HEARING ON ITEM EIGHT D.
ANYONE IN THE AUDIENCE WOULD LIKE TO MAKE A COMMENT ON THIS? HEARING NO RESPONSE.
I'M GOING TO CLOSE THE PUBLIC HEARING.
BRING THAT BACK TO COUNCIL FOR ANY ACTION.
COUNCIL MEMBER. I MOVE TO APPROVE.
I'LL SECOND. I HAVE A MOTION FOR APPROVAL.
COUNCILWOMAN ROBB, A SECOND BY COUNCILMAN LISTOWSKI.
ANY DISCUSSION? ALL THOSE IN FAVOR? THAT IS UNANIMOUS.
I WOULD LIKE TO MAKE TWO COMMENTS THAT THE DEVELOPER OF THE PROPERTY IS WORKING WITH THE CITY TO HELP US REMOVE SOME LONG BEACH PARKING, AND HAS ALSO AGREED IN THE MAIN SECTION, PROBABLY ONE OF MY OUR FUTURE HOME TO DEED RESTRICT SHORT TERM RENTALS.
SO I THANK YOU MIGHT HAVE A CONFLICT.
I THANK YOU VERY MUCH FOR THAT.
AND I THANK YOU FOR EVERYTHING YOU'RE DOING TO HELP US.
AND I HAVE HEARD SOME MENTION OF A FEDERAL GRILL MAYBE.
VERY GOOD. ALL RIGHT, LET'S HAVE ITEM NINE, PLEASE, MA'AM.
[9. PUBLIC COMMENT]
A, AGENDA ITEMS AND B, NON AGENDA ITEMS. THIS IS THE TIME FOR PUBLIC COMMENT.AS WE KNOW THIS IS A THREE MINUTE ITEM FOR THOSE THAT MAY HAVE NOT GIVEN PUBLIC COMMENT BEFORE, YOU COUNCIL CANNOT RESPOND TO YOU ON YOUR QUESTIONS OR COMMENTS AGAINST THE OPEN MEETINGS ACT TO DO THAT, BUT WE'RE HAPPY TO HAVE YOUR INPUT.
TO MAKE SURE THAT I'VE GOT THIS CORRECT.
I HAVE A NUMBER OF FORMS THAT HAVE BEEN FILLED OUT, BUT I THINK IT'S BY ALL THOSE INDIVIDUALS THAT WERE HERE FOR CLUB 68, BUT I'M GOING TO CALL THEIR NAME JUST TO MAKE SURE THEY DON'T WANT TO HAVE ANOTHER TYPE OF COMMENT.
ROSALYN JACKSON, ED BENJAMIN, DAVID MILLER, BENTA MCFARLANE
[00:40:02]
AND DOUGLAS KIM.GOOD. IF YOU ARE HERE AND WANT TO GIVE OTHER COMMENTS, PLEASE COME FORWARD.
BUT I DON'T SEE YOU HERE, SO WE'LL MOVE RIGHT AHEAD.
I'M GOING TO CALL ON MARK MORGAN.
MARK. [INAUDIBLE] THIS EVENING.
MARK MORGAN, PRESIDENT OF THE GALVESTON FIREFIGHTERS ASSOCIATION, LOCAL 571 OF THE INTERNATIONAL ASSOCIATION OF FIREFIGHTERS, OUR LOCAL WAS ESTABLISHED IN 1919 TO BE A VOICE FOR GALVESTON'S FIREFIGHTERS.
OUR CONTRACT NEGOTIATIONS WITH THE CITY HAVE BEEN AT AN IMPASSE SINCE MID SEPTEMBER.
STATE LAW STIPULATES THAT AFTER 60 DAYS OF NEGOTIATING, AN IMPASSE AUTOMATICALLY OCCURS.
NO SIDE IS REQUIRED TO DECLARE AN IMPASSE.
THE NEXT STEP IS FOR US TO REACH OUT TO POLICY MAKERS AND SET THE RECORD STRAIGHT WITH FACTS.
THIS IS AN ATTACK ON WORKERS RIGHTS FOR FIREFIGHTERS.
THE INTENT IS TO DILUTE OUR ABILITY TO HOLD THE CITY ACCOUNTABLE.
BUT THOSE PAY INCREASES ARE BEING HELD RANSOM UNLESS WE AGREE TO AN EGREGIOUS REQUEST BY THE CITY.
TODAY, I'M PROUD TO ANNOUNCE THAT OUR MEMBERSHIP VOTED AND APPROVED AN AGREEMENT THAT SATISFIES ALL ASPECTS OF OUR NEGOTIATIONS AND LEAVES THE APPEALS PROCESS LANGUAGE AS IS.
THIS LANGUAGE HAS SUITED BOTH SIDES OF THE AGREEMENT, AS I SAID FOR 40 YEARS.
WE BELIEVE THAT THIS ISSUE IS NO LONGER THE CITY MANAGER'S PURVIEW.
SINCE THE IMPASSE BEGAN, THE STATE LAW SAYS THAT NEGOTIATIONS ENDED TWO MONTHS AGO.
I BELIEVE THEY'RE OUT ON A FIRE RIGHT NOW, CURRENTLY AS WE SPEAK.
THE QUESTION IS, ARE YOU WILLING TO SUPPORT YOUR GALVESTON FIREFIGHTERS? THANK YOU. THANK YOU.
HEY, Y'ALL. I'M A TAXPAYING RESIDENT OF GALVESTON, TEXAS.
AND BASED ON WHAT I HEARD, THAT SEEMED LIKE YOU WERE PURPOSEFULLY MISLEADING THE VIEWERS IN THAT THE NET REVENUE WAS ACTUALLY GREATER THAN THE EXPENSES, AND IT WAS REPEATED OVER AND OVER AGAIN THAT THIS WAS A DEFICIT BUDGET.
AND I THINK THAT THE PUBLIC DESERVES AN ANSWER ON WHY THE CITY CFO AND COUNCILWOMAN MARIE ROBB MISLED THE VIEWERS WATCHING AND WHETHER IT WAS PURPOSEFUL, WHETHER SOMEBODY MISSPOKE, WHETHER IT WAS ACCIDENTAL OR IT WAS BECAUSE SOMEBODY WASN'T PREPARED.
I WANT TO KNOW WHY YOUR OPINION HAS CHANGED.
AND ADDITIONALLY, BOTH OF THOSE TWO INDIVIDUALS SEEM TO BE ON A CRUSADE AGAINST THE PARK BOARD.
THANK YOU. THANK YOU, MISTER BLAYLOCK.
[00:45:03]
GOOD EVENING, MAYOR AND COUNCIL.I HAVE SOME FLIERS HERE THAT I HAD EMAILED ABOUT A COMMUNITY MEETING, WHICH IS ACTUALLY IN BRAZORIA, BUT IT IS CONNECTED TO GALVESTON IN THE SENSE THAT THESE TWO COUNTIES, GALVESTON COUNTY AND BRAZORIA COUNTY, HAVE A LONG HISTORY.
BRAZORIA IS A TOWN OF LESS THAN 3000.
I AM THE CHAIR OF THE ADVISORY COMMITTEE THAT HAS BEEN WORKING ON THIS MUSEUM THAT'S BEING BUILT AT THE LEVI JORDAN PLANTATION FOR SEVERAL YEARS. I WANTED TO INVITE ALL OF THE COUNCIL MEMBERS, IF YOUR SCHEDULE ALLOWS, ON SATURDAY, NOVEMBER 18TH, ONE, TWO, 3:00 AT GREATER MOUNT ZION CHURCH FOR THE COMMUNITY MEETING SO THAT YOU CAN SEE AN EXAMPLE OF SUCCESS AND WHAT THEY'RE DOING POSITIVE IN THAT COMMUNITY TO ACCOMPLISH THE TASK OF BUILDING THAT MUSEUM.
I KNOW THAT THE COMMUNITY IS WORKING HARD NOW.
THE COUNCIL IS TO GET A HISTORIC DISTRICT IN ANOTHER AREA.
I KNOW THAT THERE IS GROWING SUPPORT FOR A JUNETEENTH MUSEUM, WHICH I HOPE IS AN INTERNATIONAL, NOT NATIONAL, FORT WORTH ALREADY HUNG THAT FLAG. WE'RE GOING TO HANG A BIGGER FLAG IF WE HAVE TO, WE'LL GO GALACTIC JUNETEENTH MUSEUM AND INVITE MARTIANS.
SOME OF THE MEMBERS THAT ARE GOING TO BE AT THAT MEETING ARE GOING TO COME TO GALVESTON.
ONE OF THOSE INDIVIDUALS IS THE RETIRED NATIONAL PARK SERVICE DIRECTOR, MR. ROBERT STANTON.
HE WANTS TO COME VISIT GALVESTON.
HE WORKED FOR THE NATIONAL PARK SERVICE BASICALLY 40 YEARS, FROM 1962 TO 2001.
YOU KNOW, MAYBE BRIAN COULD HELP ME WITH MY MATH, BUT.
EXACTLY. THAT'S PLENTY OF MONEY AVAILABLE.
BUT THE POINT IS, HOPEFULLY IF YOUR SCHEDULES ALLOW, IF YOU CAN'T MAKE IT, I CAN BRING SOME OF THE INFORMATION BACK TO SHARE WITH THE COMMUNITY HERE SO THAT WE COULD LOOK AT CASE STUDIES.
THERE ARE MODELS ON DISPLAY AT THE NEO CULTURAL CENTER RIGHT NOW.
HOPEFULLY YOU CAN GET BY AND SEE THOSE BEFORE THEY'RE TAKEN DOWN.
AS SUPPORT GROWS FOR THE REHABILITATION OF OLD CENTRAL, THAT ABSOLUTELY NEEDS TO BE DONE.
AND THAT COULD BE A FIRST STEP.
I WANT TO APPLAUD YOU ON YOUR APPROVAL.
I'M SURE YOU'VE HEARD ABOUT IT BEFORE.
SHORT TERM RENTALS, SPECIFICALLY ON THE WEST END.
IT CAME TO A HEAD LAST SUNDAY MORNING, ABOUT 4:24 IN THE MORNING, WHEN NEXT DOOR TO US, ONE OF THE TENANTS IN THAT HOUSE, FIRED OFF FIVE SHOTS FROM A SEMI-AUTOMATIC PISTOL.
THE POLICE DID ARRIVE. JAMAICA BEACH WAS THE FIRST TO ARRIVE, SECURED THE SCENE.
AFTER THAT, MEMBERS OF THE GALVESTON POLICE DEPARTMENT ARRIVED SHORTLY THEREAFTER.
TOOK HIM ABOUT 15 MINUTES, WHICH WAS A PRETTY GOOD RESPONSE IN MY OPINION.
THEY ASKED WHAT WE HEARD, APPROACHED THE HOUSE NEXT DOOR, AND THE HOUSE NEXT DOOR IS ABOUT 1000FT².
IN THE DRIVEWAY THAT MORNING THERE WERE SEVEN CARS.
THE POLICE ASKED WHAT WE HEARD.
WE TOLD THEM THEY APPROACHED THE HOUSE VERY CAUTIOUSLY.
OF COURSE THE LIGHTS WERE OUT IN THE HOUSE.
I HEARD ONE OF THE OFFICERS SAY THAT WE DON'T SEE ANY LIGHTS, BUT WE SEE FLASHLIGHTS MOVING IN THE HOUSE, SO THEY, WITH SIDE ARMS DRAWN, MOVED UP THE STAIRWELL AND ASKED EVERYBODY TO COME OUT OF THE HOUSE.
ON THEIR WAY UP, THEY DID ENCOUNTER A YOUNG MAN.
[00:50:03]
THEY ESCORTED HIM TO ONE OF THE POLICE CRUISERS, AND THEN WENT UP AND AND TALKED TO THE FOLKS IN THE HOUSE.WE HAD TO ROUST THEM OUT OF THE HOUSE.
WELL, THAT'S NOT ENTIRELY TRUE.
SINCE THEY DID, ONE PERSON WAS AWAKE BECAUSE THEY PUT HIM IN THE BACK OF A SQUAD CAR.
AND THEN THEY PROCEEDED TO TELL US THAT, WELL, THERE WAS NO BLOOD, THERE WAS NOBODY INJURED.
AND WHAT WE PROBABLY HEARD WAS PROBABLY A RADIO OR MAYBE A TV.
WELL, OF COURSE, THAT DIDN'T SIT TOO WELL WITH ME, SO I THANK THEM FOR COMING OUT.
CERTAINLY THANK THEM FOR BEING AS QUICK AS THEY WERE, THANK THEM FOR, YOU KNOW, SECURING THE SCENE.
THEY LEFT. I WENT TO WORK, AGAIN IT DIDN'T SIT WELL.
I DID FIND FIVE SPENT SHELL CASINGS, AND I THINK WHAT'S HAPPENING IS SHORT TERM RENTALS HAVE GOTTEN OUT OF HAND, AND WE'VE GOTTEN TO THE POINT THAT SHORT TERM NOW MEANS A DAY RENTAL.
SO A PERSON CHECKS IN AT 4:00.
THEY HAVE TO BE OUT OF THE HOUSE BY 11.
AND THE MAJORITY OF THAT IS AT NIGHT.
SO THEY'RE NOT ENJOYING THE BEACH.
LIFE IS NOT. THEY'RE NOT ENJOYING THE BEACH, THEY'RE NOT TAKING.
AND WE'VE SEEN THAT TIME AND TIME AGAIN WITH THE SHORT TERM RENTAL.
THANK YOU VERY MUCH FOR YOUR TIME.
THANK YOU FOR LISTENING. THANK YOU.
APPRECIATE IT. EMILY HENDERSON.
OH, I HAVEN'T STARTED TALKING ABOUT.
I JUST WANTED TO TALK ABOUT THE UNSANITARY PUBLIC PLACES.
UM, INSPECT THE RESTAURANTS AND ISLAND TRANSIT THE PUBLIC BUS SHUTTLES.
THANK YOU. UM, ALSO, YOU KNOW, I ALREADY GAVE LEGAL DOCUMENTS TO, YOU KNOW, SHARON LEWIS.
I DIDN'T LIE ABOUT WHAT HAPPENED.
HE'S A CRAZY STALKER, THAT'S A SEX OFFENDER.
I REPORTED MY PASSPORT STOLEN LAST YEAR.
LIKE, YOU CAN CHECK THAT IN THE RECORDS.
THEY STOLE FROM ME, AND THEY STOLE FROM MY FATHER'S BANK ACCOUNTS.
AND PLEASE DON'T SHAKE YOUR HEAD. THAT REALLY DID HAPPEN.
I CAN READ ON A TERTIARY LEVEL BECAUSE I HAVE A COLLEGE DEGREE.
THEY MESSED UP OUR BANK ACCOUNTS WHEN THEY STOLE OUR PERSONAL INFORMATION.
Y'ALL DON'T WANT TO FIX IT? UM, BECAUSE A SMITH FRATERNIZES WITH GOVERNMENT WORKERS.
LIKE I SAID, HE HAS FAMILY MEMBERS THAT WORK FOR THE GOVERNMENT.
THAT'S WHY THEY WON'T ARREST HIM.
HE HAS ALSO BRIBED GOVERNMENT WORKERS.
AND THAT'S WHAT THE PROBLEM IS.
THIS IS VERY SEXIST AND PREJUDICE.
AND Y'ALL KNOW IT BECAUSE Y'ALL PEOPLE TOOK BRIBES.
I DID NOT LIE. HE IS A DISGUSTING PERVERT.
I'M NOT INVOLVED IN HIS CRIMINAL ACTIVITIES JUST BECAUSE I'M BLACK AND UGLY.
I DON'T LIVE IN THE GHETTO AND I'M NOT ON DRUGS.
AND DON'T SAY TERRIBLE THINGS ABOUT ME EVER AGAIN.
I DON'T CARE IF YOU DON'T LIKE ME.
AND LET BO QUIROGA TAKE YOUR PLACE BECAUSE WE VOTED FOR HIM, NOT YOU.
YOU DIDN'T GET THE MINORITY VOTE.
IT WAS RIGGED. ALL RIGHT, MISS SHEILA.
YOU DON'T LIE ABOUT ME ANYMORE EITHER.
HI, Y'ALL. HOW ARE YOU DOING? I'M DOING FINE, SHEILA.
[00:55:05]
JUST WANTED TO SING.YES. I MEAN THAT THAT'S MY PRAYER.
AND I WANT TO SAY THIS THANKSGIVING, YOU KNOW, I KIND OF FEEL I'M AN HONEST PERSON.
I DON'T LIKE PEOPLE TO SAY, HAPPY HOLIDAYS OR HAPPY THANKSGIVING, IF Y'ALL DON'T MIND, CAN THERE'S SO MANY BEAUTIFUL PEOPLE IN THIS CITY, SO MANY BEAUTIFUL HEARTS AND LOVING PEOPLE.
THAT'S WHAT REALLY WHAT THANKSGIVING IS ABOUT.
AND I ALSO WANT TO THANK MS. ROBB. YEARS AGO, WHEN I WAS JUST TALKING ABOUT FLOODS, NOBODY WAS BELIEVING ME.
YOU KNOW, PEOPLE GOT A RIGHT TO THEIR OPINIONS AND STUFF AND I SHE BLESSED ME.
ACTUALLY, THE CITY COUNCIL DID AS WELL.
AND FOR THE FLOOD SHE WAS, SHE GOT IN THERE AND SHE DID SOMETHING ABOUT IT.
AND I'M JUST, I JUST WANTED TO SAY THAT TODAY MISS ROBB, I APPRECIATE WHAT YOU DID FOR ME.
AND I APPRECIATE ALL OF THE MANY GOOD COMMENTS I GET FROM SO MANY OF YOU WONDERFUL CITIZENS WHO WATCH THIS PROGRAM.
AND I'M SO THANKFUL TO GOD, FIRST OF ALL, FOR THE OPPORTUNITY.
AND THAT'S WHAT THIS IS ABOUT.
BIBLE SAYS TREAT OTHERS LIKE YOU WOULD HAVE THEM, YOU KNOW YOU WANT SOMEBODY TO TREAT YOU.
AND THAT'S WHAT WE'RE ALL SUPPOSED TO BE DOING.
AND I'M SO GRATEFUL THAT I GET TO STAND HERE TODAY TO CORRECT THAT, TO DO UNTO OTHERS AS YOU WOULD HAVE THEM DO UNTO YOU.
IT'S FULL OF BEAUTIFUL PEOPLE.
WE GOING TO HAVE SOME KIND OF HOLIDAY THIS CHRISTMAS AND THANKSGIVING.
IT'S ALL KIND OF FESTIVITIES GOING ON, AND THE CITY LOOKED LIKE IT JUST LIGHTS UP AROUND THE HOLIDAYS, YOU KNOW? I MEAN, OH, AND I LOVE COLORED LIGHTS.
OH MY GOSH. BUT PLEASE, Y'ALL JUST REMEMBER WHAT SHELIA BELL ASKING Y'ALL THIS TIME.
REMEMBER SOMEBODY ELSE, IF YOU SEE SOMEONE SAD, MIGHT NOT BE HAVING A GOOD DAY.
YOU COULD YOU COULD DO SOMETHING.
IF IT AIN'T ABOUT A HERSHEY'S, I'LL TAKE A HERSHEY'S, YOU KNOW WHAT I MEAN? JUST BE NICE TO SOMEBODY.
OH, AND I MADE A GUMBO THE OTHER DAY.
YOU KNOW, PEOPLE HAVE BEEN TELLING ME FOR YEARS I MAKE THE BEST GUMBO THEY EVER HAD, AND.
WE HAVE. NOW, IS THERE ANY OTHER PUBLIC COMMENTS? LET'S MOVE FORWARD.
ITEM TEN IS ORDINANCE NOT REQUIRING PUBLIC HEARINGS 10 A.
[10.A. Consider For Approval An Ordinance Of The City Of Galveston, Texas, Amending "The Code Of The City Of Galveston 1982, As Amended”, Chapter 19, “Licenses, Permits And Business Regulations”, Article Vi, “Short Term Rentals” Section 19-113, To Provide Regulations On The Use Of Recreational Vehicles As Short Term Rentals; Making Various Findings And Provisions Relating To The Subject And Providing For An Effective Date. X. Vandiver-Gaskin)]
BUSINESS REGULATIONS, ARTICLE SIX.SHORT TERM RENTALS, SECTION 19-113 TO PROVIDE REGULATIONS ON THE USE OF RECREATIONAL VEHICLES AS SHORT TERM RENTALS, MAKING VARIOUS FINDINGS AND PROVISIONS RELATED TO THE SUBJECT AND PROVIDING FOR AN EFFECTIVE DATE.
VERY GOOD. GOOD EVENING TO YOU.
I'M XOCHITL VANDIVER-GASKIN WITH THE CITY ATTORNEY'S OFFICE.
AND WHAT THIS AMENDMENT IS REALLY DOING IS JUST KIND OF PULLING TOGETHER REGULATIONS THAT EXIST IN OTHER AREAS OF THE CODE AND THE ELDERS THAT THAT DON'T ALLOW RVS TO BE OUTSIDE OF AN RV PARK, TO BE USED AS AN ACCESSORY DWELLING UNIT OR AS A SHORT TERM RENTAL.
SO WHAT THIS AMENDMENT IS ASKING, OR WHAT I'M ASKING, IS THAT THE AMENDMENT JUST KIND OF STATES IT VERY PLAINLY IN THE SHORT TERM RENTAL SECTION CAN'T USE RVS AS SHORT TERM RENTALS OUTSIDE OF AN RV PARK.
THE SECOND PART IS THE ACCESSORY BUILDING.
AND THAT'S JUST IF YOU LOOK AT THE DEFINITION OF ACCESSORY BUILDING, IT INCLUDES A LOT OF THINGS THAT I DON'T SUSPECT THE CITY WOULD WANT TO BE USED AS SHORT TERM RENTALS, SUCH AS A GARDEN SHED OR A WORKSHOP.
AND SO THE AMENDMENT THAT I'M PROPOSING IS JUST TAKES THE TWO WORDS ACCESSORY BUILDING OUT OF SHORT TERM RENTAL DEFINITIONS TO KIND OF MAKE IT AGAIN, VERY CLEAR IN ONE PLACE. VERY GOOD.
WE'VE DISCUSSED THAT I KNOW AT COUNCIL AND OUR WORKSHOP AND COUNCIL ANY QUESTIONS WE HAVE .
I'D LIKE TO MAKE ONE QUESTION.
YES, SIR. AN ACCESSORY BUILDING IS DIFFERENT THAN AN ACCESSORY DWELLING UNIT, CORRECT? YES. VERY GOOD.
I'LL MAKE A MOTION TO APPROVE.
A MOTION FOR APPROVAL OF ITEM 10A.
WE HAVE A SECOND BY COUNCILMAN COLLINS.
[01:00:02]
ANY DISCUSSION? EVEN THOUGH IT COST ME MY GARDEN SHED AS A RENTAL.YOU CAN STILL GO IN. AND YOU CAN.
ALL THOSE IN FAVOR? THAT IS UNANIMOUS.
[10.B. Consider For Approval An Ordinance Of The City Of Council Of The City Of Galveston, Texas, Designating Its Meeting Days For The Year 2024; Reserving The Right Of Council To Schedule Additional Meetings As Needed; Providing For Findings Of Fact And For An Effective Date. (Legal)]
ITEM TEN B, CONSIDER FOR APPROVAL AN ORDINANCE OF THE CITY OF COUNCIL OF THE CITY OF GALVESTON, TEXAS, DESIGNATING ITS MEETING DAYS FOR THE YEAR 2024 RESERVING THE RIGHT OF COUNCIL TO SCHEDULE ADDITIONAL MEETINGS AS NEEDED.PROVIDED FOR FINDINGS OF FACT AND FOR AN EFFECTIVE DATE.
IN OUR PACKET MATERIAL COUNCIL, THEY ARE LISTING THE DATES FOR OUR 2024 FISCAL YEAR COMING UP AND OF OUR COUNCIL MEETINGS. AND WITH THIS MOTION, I'M GOING TO MAKE A MOTION TO APPROVE THE COUNCIL DATES.
MEETING DATES AS OUTLINED IN ITEM TEN B WITH THE START OF OUR WORKSHOPS AT 9 A.M., WITH OUR REGULAR MEETING AT 5 P.M., UNLESS THERE ARE CHANGES THAT WOULD BE DEEMED NECESSARY.
DO I HAVE A SECOND FOR THAT? I'LL HAVE A SECOND FOR COUNCILWOMAN.
ROBB. I THINK IT'S ONLY FROM 5 TO 7, RIGHT? NO, WE DIDN'T PUT IT IN DATE ON IT, SO.
ALL THOSE IN FAVOR? THAT IS UNANIMOUS.
[11. CONSENT ITEMS]
ITEM 11, CONSENT ITEMS. THE FOLLOWING ITEMS SHALL BE CONSIDERED FOR ACTION AS A WHOLE, UNLESS ONE OR MORE COUNCIL MEMBERS OBJECTS.CONSENT ITEMS 11 A THRU 11 Q ARE ON THE SCREEN.
VERY GOOD. THESE ARE ITEMS 11 A THROUGH 11 Q.
ARE THERE ANY ITEMS THAT COUNCIL MEMBERS WOULD LIKE TO PULL OUT TO DISCUSS SEPARATELY? HEARING NO RESPONSE ON THAT, I'M GOING TO MAKE A MOTION FOR APPROVAL OF ITEMS 11 A THROUGH 11 Q.
I WOULD SECOND. WE HAVE A SECOND BY COUNCILMAN COLLINS.
11 A HAS BEEN DEFERRED TO DECEMBER MEETING.
IN THE DISCUSSION POINT I WANT TO IN 11 B I WANT TO THANK TOM FARMER.
THIS IS SOMEWHAT OF A DIFFICULT TASK, AND MR. FARMER HAS GOT A GOOD ATTITUDE EACH YEAR.
HE'S HAPPY TO SERVE AND DO WHAT HE CAN TO ASSIST THE RESIDENTS OF GALVESTON COUNTY AND OF GALVESTON.
SO I WANT TO FORMALLY THANK MR. FARMER ON THAT.
ANY FURTHER DISCUSSION ON THESE ITEMS? ALL THOSE IN FAVOR? THAT IS UNANIMOUS.
[12.A. Consider for approval the FY 2024 Park Board of Trustees Annual Budget. (C. Ludanyi)]
IS SHEILA HERE? BRIAN? YES SHE IS.OKAY. WE COULD BRING HER OVER, PLEASE.
THIS ITEM WE HAD RECEIVED, SHEILA, WE HAD RECEIVED A NOTICE FROM CITY MANAGER HERE THIS AFTERNOON CONCERNING SOME COMMUNICATION THAT YOU HAVE HAD WITH THE PARK BOARD.
COULD YOU GO OVER THAT WITH COUNCIL, PLEASE? ABSOLUTELY. I REACHED OUT TO THE PARK BOARD AFTER OUR WORKSHOP THIS MORNING, AND BRYSON CALLED ME RIGHT BACK, AND HE CONFIRMED THAT OUR NUMBERS FROM THIS MORNING WERE CORRECT, AND HE HAD JUST OVERLOOKED THE RECEIVABLE ON THEIR FINANCIAL REPORT AND HIS CALCULATIONS.
TENTATIVELY, THEIR FINANCE TEAM KIND OF LOOKED AT IT, AND I DON'T KNOW IF COUNCIL RECALLS, BUT THERE WAS UNASSIGNED OR ASSIGNED UNRESTRICTED FUND BALANCE LEFT IN BEACH CLEANING, BEACH PATROL AND NOURISHED BEACH.
AND IT'S RIGHT ABOUT $1.2 MILLION.
AND THEY THINK THEY CAN USE IT TO OFFSET THAT GENERAL FUND DEFICIT.
HOWEVER, IT WILL NEED TO GO BACK TO THEIR BOARD, THEIR AUDITORS WILL NEED TO REVIEW IT.
AND SO THEY ARE GOING TO SEND US AN UPDATED PLAN WHEN THEY GET THAT TOGETHER.
[01:05:02]
INFORMATION TO COUNCIL AS WELL.ALL RIGHT. IS THERE ANY QUESTIONS THAT WE HAVE FROM MISS LADANYI? VERY GOOD.
I'M GOING TO MOVE TO DEFER THE BUDGET ITEM TO OUR NEXT MEETING.
YOU MEAN DECEMBER 13TH, DECEMBER 13TH OR 14TH.
DECEMBER 14TH. PARDON ME, I WOULD I WOULD SECOND THAT.
WE HAVE A MOTION FOR DEFERRAL AND A SECOND BY COUNCILMAN COLLINS.
ANY DISCUSSION COUNCIL? YES, DAVID.
I ASKED THE QUESTION IF ON FY 2024 BUDGET, IF IT TRULY WAS A DEFICIT BUDGET, IF IN FACT THE EXPENSES FOR THE YEAR WERE IN EXCESS OF THE REVENUE, AND I RECEIVED AN UPDATED BUDGET FROM THE CITY SECRETARY, AND ON THE EIGHTH PAGE OF IT, IT GIVES A SUMMARY WHERE IT SAYS THE PARK BOARD OF TRUSTEES PRESENTS A BALANCED BUDGET WITH A NET BOTTOM LINE OF 1.854 MILLION REVENUE IN EXCESS OF EXPENSES.
SO I'D LIKE TO BE PERFECTLY CLEAR ON THIS.
I THINK THE ISSUE THAT WE'VE BEEN TALKING ABOUT HAVE BEEN THESE NEGATIVE FUND BALANCES.
SO WHEN WE TALK ABOUT WHETHER THEY PRESENTED US A BALANCED BUDGET, I THINK THE ANSWER IS YES.
I DO THINK THAT YES, I UNDERSTAND THE THE REQUEST FOR DEFERRAL, BUT I WOULD LIKE TO JUST ENTER THAT INTO THE RECORD THAT I SEE VERY CLEARLY FROM THE BUDGET THAT THEY PRESENTED US, A BUDGET THAT SAYS THE REVENUES ARE IN EXCESS OF THEIR EXPENSES.
THANK YOU. WAS THERE A QUESTION? WELL, THE QUESTION IS, IS THAT WELL, YES, THE QUESTION.
QUESTION. WHAT IS THE RISK OF DEFERRING THIS BUDGET FOR UNTIL DECEMBER 13TH AND NOT FUNDING THE FIRST QUARTER OF THE PARK BOARD'S BUDGET? MY UNDERSTANDING IS, IS THAT WE CANNOT SEND THE MONEY TO THE PARK BOARD UNTIL THERE IS AN APPROVED HOT CONTRACT.
SO APPROVAL OF THE BUDGET IS ONE THING.
BUT EVEN IF THE BUDGET IS APPROVED, MY UNDERSTANDING FROM THE LEGAL TEAM IS THAT THE CITY FINANCE DEPARTMENT CANNOT SEND THE MONEY UNTIL THAT HOT CONTRACT IS APPROVED, SO THAT I DON'T BELIEVE THAT'S HAPPENING UNTIL DECEMBER.
WHAT IS THE RISK TO PARK BOARD OPERATIONS IF THE MONIES ARE NOT TRANSFERRED? YOU MEAN BY TRANSFER TODAY AS COMPARED TO DECEMBER 14TH? YEAH. I MEAN, WHAT'S THE WHAT'S THE RISK TO PARK BOARD OPERATIONS? I MEAN, DO WE HAVE PROJECTS THAT ARE AT RISK, YOU KNOW, DOES ANYTHING STOP OVER AT THE PARK BOARD BY US NOT SENDING OVER THE MONEY? BECAUSE AS WE HEARD EARLIER IN THE WORKSHOP, THERE IS AND WE'RE IN THE EVERGREEN PERIOD.
DAN BUCKLEY MENTIONED THAT WE'RE IN THE EVERGREEN PERIOD OF AN AGREEMENT.
AND SO IF THERE'S AN AGREEMENT, INTERIM AGREEMENT IN PLACE, IS THERE NOT METHOD BY WHICH WE CAN SEND MONEY TO THE PARK BOARD? OH. IF I COULD CLARIFY, WE'RE IN THE EVERGREEN PERIOD OF OUR INTERLOCAL INTERLOCAL AGREEMENT, NOT TO THE TRANSFER OF FUNDS, NOT TO THE THE EVERGREEN.
MY COMMENT WAS GOING TO BE THAT THE BUDGET IS NOT THE MECHANISM BY WHICH THE FUNDS ARE TRANSFERRED.
THAT'S THE HOT CONTRACT AND THAT IS STILL ON THE STILL UNDER CONSIDERATION.
SO THE ANSWER TO DAVID, I THINK WOULD BE NO IMPACT AT ALL.
WE CERTAINLY DON'T HAVE IT TODAY.
AND THE EFFECT ON THE EFFECT ON FUND TRANSFER OF DEFERRING THIS IS NIL.
THANK YOU, COUNCILMEMBER COLLINS.
COUNCILMEMBER CAN ALSO CLARIFY.
THE EVERGREEN IS AN AUTOMATIC RENEWAL CLAUSE.
AND THAT DOESN'T ADDRESS THE FUNDING OF HOT FUNDS.
OKAY. THANK YOU, MR. BUCKLEY. COUNCILMAN BOUVIER.
[01:10:02]
WHAT THEIR FUNDS ARE.AND ARE WE PUTTING OFF OR ARE THEY PUTTING OFF PROJECTS TO OPERATE THE PARK BOARD? GOOD EVENING COUNCIL.
THANK YOU FIRST AND FOREMOST FOR YOUR KIND WORDS EARLIER.
I'M SORRY I WASN'T HERE IN PERSON, BUT I DID HEAR THEM, SO THANK YOU VERY MUCH.
I CAN TELL YOU THAT WE DO HAVE SOME FUNDS AVAILABLE.
SO WE DO HAVE FUNDS IN THE BANK AVAILABLE TO CONTINUE PAYING OUR EMPLOYEES AND KEEPING THE LIGHTS ON AS FAR AS PROJECTS ARE CONCERNED, YES, WE ARE IN A HOLD ON MANY OF OUR PROJECTS BECAUSE WE WANT TO MAKE SURE THAT WE HAVE THE FUNDING THAT'S GOING TO BE ADEQUATE TO BE ABLE TO PROCEED WITH THOSE, AND IT WOULD BE NEGLIGENT, AS US, AS LEADERS OF THE ORGANIZATION, TO OUR EMPLOYEES TO PROCEED WITH THESE LARGE MULTI-MILLION DOLLAR PROJECTS.
IF WE DON'T HAVE A MECHANISM IN PLACE VIA THE HOT CONTRACT TO RECEIVE FUNDS FROM THE CITY.
I WOULD LIKE TO MAKE A STATEMENT ABOUT OUR STAFF.
EVEN IF I DO CALL YOU THE WRONG NAME.
BUT SINCE WE WERE BOTH AFFRONTED IN SOMEONE'S COMMENT, I WANT TO MAKE SURE THAT ONE.
THE ITEMS THAT WE RECEIVED WERE RECEIVED YESTERDAY.
AND THE PARK BOARD AND MR. BRYSON FRAZIER, WHO I LIKE IS A GREAT GUY.
I AM NOT ATTACKING THE PARK BOARD, ADMITTED THAT THERE WERE ERRORS IN THE BUDGET, AND SHEILA WAS ABLE TO FIND THEM BECAUSE SHE DOES A FANTASTIC JOB.
I AM PROUD OF OUR STAFF AND EVERYTHING THAT THEY REPRESENT.
SO I PERSONALLY WANT TO THANK YOU, AND I DON'T THINK THERE WERE ANY STATEMENTS MADE TO MISLEAD ANYONE, AND THAT'S ALL.
THANK YOU. WE HAVE A MOTION ON THE FLOOR FOR DEFERRAL TO OUR DECEMBER 14TH MEETING.
ANY FURTHER DISCUSSION ON THAT COUNCIL? ALL THOSE IN FAVOR? 345. ALL RIGHT.
WE HAVE FIVE IN FAVOR AND COUNCILMAN FINKLEY, ALL THOSE OPPOSED? COUNCILMAN FINKLEY.
WE WILL THEN DISCUSS THIS ON DECEMBER 14TH.
THANK YOU. LET'S MOVE TO ITEM 12 B PLEASE.
[12.B. Consider for action related to the litigation In re: Aqueous Film-Forming Foams Product Liability Litigation, MDL No. 2:18-mn-02873; City of Camden, et al., v. E.I. DuPont de Nemours and Company, et al., No. 2:23-cv-03230-RMG giving the City Attorney a course of action related to participation in the case. (Legal)]
218MN02873. CITY OF CAMDEN ET AL.V E.I. DU PONT DE NEMOURS AND COMPANY ET AL.
GIVEN THE CITY ATTORNEY A COURSE OF ACTION RELATED TO PARTICIPATION IN THE CASE.
THANK YOU NELLIE. THIS WAS DISCUSSED THIS MORNING IN OUR EXECUTIVE SESSION.
IN RESPONSE TO THAT, I WOULD LIKE TO MAKE A MOTION IN THE LITIGATION STYLED CONCERNING AQUEOUS FILM FORMING FOAMS PRODUCTION LIABILITY. I MOVED TO AUTHORIZE THE CITY ATTORNEY TO FILE ANY NECESSARY DOCUMENTS FOR THE CITY OF GALVESTON TO OPT OUT OF THIS LITIGATION, AS HE DEEMS IT APPROPRIATE TO DO SO.
IS THERE A SECOND? I WOULD SECOND THAT.
ANY DISCUSSION ON THAT? ALL THOSE IN FAVOR? THAT IS.. I AM GOING TO ABSTAIN JUST SIMPLY BECAUSE I WASN'T HERE AND DO NOT KNOW THE..
GOOD POINT. WE HAVE FIVE IN APPROVAL.
VERY GOOD. LET'S MOVE TO ITEM 12 C, PLEASE.
[12.C. Discuss and consider appointments to the following City boards, commissions, and committees.]
MR. MAYOR. YES, I MAKE A COMMENT ABOUT THIS ITEM.ABOUT THIS ITEM? ABOUT THIS ITEM.
THIS IS APPOINTMENTS TO THE FIREFIGHTERS PENSION BOARD.
I KNOW THAT IS YOUR TO MAKE AND THE POLICE PENSION FUND WHICH IS A COUNCIL APPOINTMENT.
BUT I HAVE A CONCERN ABOUT THE IMPORTANCE OF THESE POSITIONS.
[01:15:02]
THESE BOARDS HAVE THE POTENTIAL TO SIGNIFICANTLY IMPACT CITY FINANCES FOR YEARS INTO THE FUTURE BY THEIR DECISIONS.AND THE BOARDS ARE EQUALLY COMPOSED OF HOW WOULD WE PUT IT THAT IT'S KIND OF HALF FIREFIGHTERS, HALF CITY, YOU KNOW, AND THE SAME, I THINK, WITH THE POLICE UNION AND THAT SYSTEM WORKS VERY WELL.
BUT AT THE SAME TIME, IF WE MAKE A IF WE DON'T HAVE MUCH OVERSIGHT OF THESE APPOINTMENTS, THERE'S THERE'S JUST POTENTIAL FOR GREAT HARM, EVEN INCIDENTAL HARM BY APPOINTING THE WRONG PEOPLE TO THESE.
I WOULD LIKE TO SEE US INTERVIEW FOR THESE POSITIONS.
THESE ARE MORE IMPORTANT THAN POSITIONS FOR EVEN THE PLANNING COMMISSION.
I MEAN, YOU KNOW, AND WE GO TO SOME LENGTHS TO INTERVIEW THOSE.
I DON'T THINK WE WOULD HAVE A GREAT NUMBER OF CANDIDATES, BUT I THINK THE I WOULD LIKE TO SEE CITY COUNCIL AND CITY STAFF HAVE SOME INPUT, AS WE DO ON THOSE OTHER APPOINTMENTS ON, ON THESE PENSION BOARDS, JUST BECAUSE OF THE POTENTIAL FOR FINANCIAL IMPACT GOING FORWARD.
ALL RIGHT. FIRST OF ALL, BEFORE WE ANSWER THAT, DAVID, I WANT JANELLE ON THE PENSION, THE FIREFIGHTERS PENSION AND THE POLICE PENSION BOARD.
WE AT ONE POINT FELT THEY FELL UNDER THE TERM LIMIT QUALITIES OF OUR COMMITTEES AND BOARDS.
IS THAT RIGHT, JANELLE? CORRECT. BECAUSE THEY'RE NOT.
THEY DON'T FALL UNDER THE TERM LIMITS BECAUSE THEY'RE NOT CITY CREATED BOARDS.
THEY WERE CREATED BY THE PENSION PLAN.
OKAY. YEAH, THAT THAT THAT DOESN'T ANSWER YOUR QUESTION.
IT'S NOT ABOUT THE CANDIDATES THEMSELVES.
IT'S ABOUT THE POTENTIAL FOR FINANCIAL IMPACT OF THESE.
I WOULD LIKE MORE INFORMATION.
I JUST THINK THAT'S IMPORTANT.
I DON'T HAVE ANY CONCERN WITH ITEMS ONE THROUGH FIVE THE WAY WE'VE DONE THOSE.
ALL RIGHT, LET'S DO THIS. DAVID.
WE'RE GOING TO TAKE THESE IN ORDER HERE.
AND WHEN WE COME TO THAT POINT, YOU NEED TO PUT THAT IN A MOTION SO WE CAN VOTE THAT ON THAT.
IT'S LET'S MOVE TO MR. O'QUINN'S POSITION IN AIRPORT ADVISORY IS TERM LIMITED.
DAVID, DO YOU HAVE ANYONE FOR THAT? I DO, PREVIOUSLY I HAD A CANDIDATE WHO HAD SERVED PREVIOUSLY AND HAS SINCE ASKED THAT ACTUALLY HIS WIFE, WHO IS VERY FAMILIAR WITH AIRPORT OPERATIONS, GIVEN THE FACT THAT JAMIE WAS A PILOT FOR AGES, I'D LIKE TO NOMINATE EILEEN DONLON FOR THE POSITION.
AND WHAT WAS HER NAME AGAIN? EILEEN DONLON.
I'M GOING TO TEXT IT TO YOU RIGHT NOW.
WE HAVE A MOTION FOR A NOMINATION FROM COUNCILMAN FINKLEY.
ANY DISCUSSION? ALL THOSE IN FAVOR? THAT IS UNANIMOUS.
WE HAVE A CIVILIAN REVIEW BOARD, WHICH IS MY APPOINTMENT.
I DO NOT HAVE ANY BODY AT THIS POINT FOR THAT POSITION.
WE HAVE ON THE ETHICS COMMISSIONS.
THIS IS DISTRICT FIVE AND SIX IS THIS I DON'T HAVE A PERSON FOR THIS POSITION YET.
JUST LET ME KNOW. AND I AGREE WITH THAT BECAUSE I'M STILL INTERVIEWING PEOPLE.
LET ME KNOW WHEN YOU WANT IT BACK. YES OKAY.
THIS THIS BOARD REALLY DOESN'T MEET.
THEY HAVEN'T MET IN A LONG TIME.
JUSTIN WE'RE NOT HAVING I WANT TO MAKE SURE I GET THE RIGHT PERSON ON THAT ONE.
WE HAVE FINANCE, PHYSICAL AFFAIRS AND INVESTMENT.
THIS IS DISTRICT ONE, THIS COUNCILWOMAN LOUIS.
BELINDA DAVIS, BELINDA, BELINDA DAVIS, BELINDA DAVIS I WOULD NOMINATE BELINDA DAVIS ON BEHALF OF.
I'LL SECOND. WE HAVE A NOMINATION.
[01:20:01]
ALL RIGHT. THAT IS TAKEN CARE OF.WE HAVE GALVESTON HOUSING FINANCE CORPORATION.
THIS IS OPEN FOR ANY NOMINATIONS.
ANYONE HAVE A NOMINEE? WE'LL COME BACK ON THAT ONE THEN, JANELLE, IF YOU'LL MAKE A NOTE OF THAT.
ON WE HAVE PENSION, FIREFIGHTERS, PENSION BOARD.
WAYNE BROWN HAS SERVED ON THAT BOARD FOR A NUMBER OF YEARS.
I TALKED TO MR. BROWN AT LENGTH A COUPLE OF DAYS AGO.
HE IS VERY ANXIOUS TO CONTINUE TO SERVE ON THAT BOARD AS A SITTING MEMBER OF THE BOARD.
I WOULDN'T HAVE ANY ISSUE WITH THAT.
SO I'M GOING TO NOMINATE MR. BROWN FOR THE PENSION, FIREFIGHTERS PENSION BOARD.
AND I THINK, JANELLE, YOU SAID WE REALLY DON'T NEED TO NOMINATE HIM.
IS THAT A MAYORAL APPOINTMENT? YEAH. SO I APPOINT MR. BROWN IF WE COULD.
AND MOVING TO THE PENSION POLICE.
I HAD A NOMINEE MR. SCOTT GORDON, THAT I HAVE.
HE MEETS ALL OF THE CRITERIA AND I THINK HE WOULD SERVE WELL ON THAT POLICE PENSION BOARD.
BUT I'M GOING TO OPEN UP FOR ANY OTHER THOUGHTS ON THIS, DAVID.
AGAIN, YOU KNOW, WITH ALL DUE RESPECT TO MR. GORDON AND MR. BROWN, BOTH, WHEN WE MAKE NEW APPOINTMENTS TO VACANT POSITIONS ON HERE, I REALIZE WE'RE NOT DOING THAT FOR FIREFIGHTERS PENSION, BUT WE ARE ON THE POLICE PENSION BECAUSE OF THE POTENTIAL FINANCIAL IMPACT THIS HAS DOWN THE ROAD, WE CAN MAKE AN APPOINTMENT THAT WILL HAVE IMPACT WELL BEYOND THE INFLUENCE OF THE CITY COUNCIL.
I WOULD MOVE THAT WE DEFER THIS APPOINTMENT AND THAT WE SET UP TO INTERVIEW CANDIDATES FOR THESE POSITIONS GOING FORWARD.
IS THERE A SECOND? CAN WE DO THAT RIGHT NOW? WELL, WE WOULD HAVE TO DEFER.
AS I SAY, WE DEFER THIS APPOINTMENT AND THEN AT A FUTURE MEETING OR A FUTURE WORKSHOP, INTERVIEW CANDIDATES FOR THIS POSITION, I MEAN, WHAT WHAT? IS OUR COURSE OF ACTION HERE DESIGNATED BY SOME TYPE OF, DO WE HAVE THIS WRITTEN DOWN HOW THESE POSITIONS GET FILLED AND DO WE NEED TO CHANGE THAT OR CAN WE JUST.
WELL, WE COULD CERTAINLY DEFER THE APPOINTMENT.
THAT IS THAT IS PRECISELY WHAT I'M SAYING.
I CAN GO GET THE CRITERIA REAL QUICK IF YOU WANT TO..
BUT IT'S CRITERIA FOR THE POSITION, NOT THE APPOINTMENT PROCESS ITSELF.
I THINK THAT'S WHAT COUNCILMAN LISTOWSKI IS ASKING.
OKAY. WE DON'T HAVE THAT WRITTEN ANYWHERE WHERE INTERVIEWS ARE REQUIRED.
SO WE COULD BUT WE COULD DO THAT IF IT MET COUNCIL'S APPROVAL, I GUESS IT WOULD BE SIMILAR TO THE PROCESS YOU'VE ADOPTED FOR I THINK THE PORT AND PARK BOARD AND THE PLANNING COMMISSION.
NOW, WE DON'T LET ME COME BACK.
WE'VE GOT A MOTION TO MOVE THIS PARTICULAR POSITION TO AN INTERVIEW TYPE APPROACH.
BUT CAN WE DO THAT AT THIS MEETING? I MEAN, THAT'S NOT THE MOTION I THINK IS TO DEFER.
NOW HOW DO WE MOVE FORWARD THEN IN GETTING INTO THE INTERVIEW PROCESS.
BECAUSE THAT'S OUTLINED IN OUR POLICY.
IS IT NOT JANELLE ON THOSE THAT ARE INTERVIEWED? NOT FOR THIS BOARD.
NO. RIGHT. BUT WE WOULD HAVE TO WE WOULD HAVE TO ADD THAT TO OUR..
WELL, IF YOU WANTED TO DEFER IT FOR A MONTH, UH, TO BE CONSIDERED AT THE NEXT MEETING IN PERHAPS INVITE THIS GENTLEMAN IN FOR A CHAT AT WORKSHOP.
YOU COULD DO THAT WHILE YOU COME UP WITH A PROCEDURE FOR FUTURE APPOINTMENTS.
OKAY. I MEAN, DO YOU HAVE SOMEBODY ELSE IN MIND? NO, NO, NOT AT ALL. NO, NO.
NOT JUST SCOTT, BUT I MEAN ANY ANY APPLICANT BECAUSE I'M JUST CONCERNED ABOUT I MEAN, WE'VE SEEN THE IMPACT OF THIS BOARD AND ITS DECISIONS IN PAST YEARS, AND IT'S NOT TRIVIAL. YOU KNOW, AS A MATTER OF FACT, IT'S PROBABLY THE MOST I DON'T WANT TO SAY UNSTABLE THING IN OUR BUDGET, BUT IT YOU KNOW, FEW THINGS CAN RISE UP AND SURPRISE US, I THINK THE WAY THIS CAN.
JANELLE, HAVE WE HAD ANY APPLICATIONS FOR THIS POSITION OR ANYONE HAVE ANY INTEREST IN IT?
[01:25:04]
WE HAVE NOT. WELL, BUT LET'S RECALL THAT THIS IS THE SECOND WE HAVE NOT.BUT LET'S RECALL THIS IS THE SECOND SUCH APPOINTMENT BECAUSE WE DID AGREE TO APPOINT SOMEONE LAST MONTH, BUT THAT PERSON TURNED OUT TO BE NOT ELIGIBLE BY STATE CRITERIA.
CORRECT. AND SO THIS THIS HAS BEEN OPEN ALREADY.
SO YOU HAVE A MOTION FOR DEFERRAL.
YEAH. THANK YOU. ALL RIGHT. WE HAVE A SECOND.
AND SO WE WOULD BRING BACK THE POLICY THAT WE'VE USED IN PLANNING AND WORKS BOARD, AND ADOPT THAT POLICY FOR THIS BOARD.
IF YOU'D LIKE, WE CAN STAFF DEVELOP A RECOMMENDED PROCESS AND PUT IT TO YOU AT WORKSHOP NEXT MONTH.
YEAH. I MEAN, WE COULD WE COULD DO THAT.
WE COULD EVEN JUST DO A QUESTIONNAIRE IF YOU WANT.
IT DOESN'T SEEM TO HAVE TO BE ELABORATE TO ME.
NO, NO NO NOT AT ALL. WELL WRITTEN DOWN.
KNOW HOW TO APPOINT TO THIS BOARD.
RIGHT. SO IS IT GOING TO BE FOR BOTH PENSION BOARDS.
I WOULD LIKE TO SEE THAT AS WELL.
BUT AS THAT IS A MAYORAL APPOINTMENT, THE WHAT OUR WHAT A PROPER PROCESS WOULD BE ON THIS.
AGAIN, I DON'T UNDERSTAND WHY.
HOW ARE THE OTHER ALL THE APPOINTMENTS MADE BY THE MAYOR? NO. NO. NO, THE POLICE PENSION FUND IS AN OPEN BY CITY COUNCIL..
BUT ARE ALL IF I UNDERSTAND MARIE'S QUESTION, ARE ALL FIREFIGHTERS PENSION BOARD POSITIONS, MAYORAL POSITIONS? NO. SO THIS IS JUST THE ONE I SEE.
OKAY. WELL THEN THEN I WOULD THEN I WOULD LIKE TO DO THIS FOR BOTH.
WE DON'T NEED TO DEFER FIREFIGHTERS OF COURSE, BECAUSE WE HAVE A FULL BOARD.
BUT I WOULD LIKE TO SEE A POLICY FOR A QUESTIONNAIRE OR INTERVIEW, I WOULD SAY AT COUNCIL'S DISCRETION BECAUSE WE HAVE THAT FOR THE WE CAN CHOOSE TO INTERVIEW OR NOT INTERVIEW CANDIDATES FOR THOSE OTHER BOARDS.
BUT IT IS AN APPLICATION PROCESS AND YES, WITH A QUESTIONNAIRE AND SO FORTH.
THERE ARE MANY BOARDS YOU DO NOT INTERVIEW FOR.
BUT WE DID NOT BECAUSE OF THE WEIGHT OF THE APPLICATIONS.
AND I'D LIKE TO SEE THE SAME APPLIED TO THIS.
FOR THE POLICE PENSION FUND? I'D LIKE TO SEE IT FOR BOTH.
I'D MISUNDERSTOOD THAT THIS WAS NOT NOT THE MAYORAL POSITION, BUT FOR THE OTHERS.
OKAY. ARE THE OTHERS, THE QUESTION WOULD BE ARE THE OTHERS BY DISTRICT? NO, NO.
I KNOW I JANELLE'S CHECKING ON THAT TO SEE ON THAT BUT YES JANELLE.
LET ME JUST LOOK. I MEAN, YOU JUST WANT TO BE ABLE TO HAVE SOME TYPE OF FACE TO FACE WITH THE PEOPLE OR QUESTIONNAIRE OR.
YES. YES. WHAT WHAT CRITERIA DO YOU NEED TO VOTE ON SOMEBODY FOR A POSITION ON THIS BOARD? DO WE APPOINT ALL THE POSITIONS ON THIS BOARD? NO, HALF OF THEM ARE CITY.
ON THE FIREFIGHTER PENSION BOARD, THE FIRST POSITION IS THE MAYOR DESIGNEE.
THE SECOND POSITION IS THE CFO OR A DESIGNEE.
THE NEXT THREE POSITIONS ARE ELECTED BY MEMBERS OF THE PLAN AND THEN MEMBERS OF THE PLAN.
MEMBERS OF THE PLAN AND THEN THE LAST TWO POSITIONS ARE CITIZENS ELECTED BY THE MAJORITY OF THE MEMBERS OF OF THE PLAN.
SO CITY COUNCIL DOES NOT HAVE ANY INPUT.
YEAH. OF THE MEMBERS OF THE BOARD I'M SORRY.
RIGHT. OKAY. SO YOU'RE RIGHT THAT THE COUNCIL DOES NOT HAVE A POSITION.
COUNCIL DOES NOT HAVE AN APPOINTED POSITION ON..
OKAY. BUT THE FIRE, THE POLICE PENSION.
SO THE POLICE YOU'VE GOT PRESIDENT OF THE GNPA, YOU'VE GOT TWO POSITIONS APPOINTED BY THE CITY MANAGER, TWO POSITIONS APPOINTED BY COUNCIL AND THEN THREE POSITIONS THAT ARE ELECTED BY THEIR PLAN.
AND WE HAVE MEMBERS OF THE PLAN.
SO WE HAVE TWO POSITIONS APPOINTED BY COUNCIL AND WHO ONE OF THEM IS VACANT.
[01:30:03]
IS THAT CORRECT? YES. AND WHO FILLS THE OTHER POSITION? COUNCIL. HAL ROCHKIND.AND DOES THAT COME UP FOR DOES HE CONTINUE TO SERVE UNLESS WE HEAR FROM HIM AND HE RESIGNS? NO, IT COMES UP EVERY TWO YEARS.
YOU VOTE ON THAT EVERY TWO YEARS.
ALL RIGHT. AND HE'S MR. ROCHKIND IS NOT HE'S NOT UP FOR RENEWAL AT THIS POINT.
IF I, IF I COULD COMMENT THE REASON I THINK THERE'S EVIDENCE OF THE PRUDENCE OF DOING IT THIS WAY IS BECAUSE WE DID MAKE AN APPOINTMENT LAST MONTH WITHOUT CONSIDERING THE QUALIFICATIONS, BECAUSE THAT PERSON, AS IT TURNED OUT, WAS NOT QUALIFIED FOR THE POSITION.
AND I, YOU KNOW, AGAIN, I DON'T I'M NOT GOING TO NAME THAT PERSON.
BUT BUT THE STATE REQUIREMENTS WERE NOT MET BY THE PERSON WE APPOINTED.
AND SO WE BE SENT THE REQUIREMENTS.
YES. YEAH. AND SO I'D LIKE I JUST WOULD LIKE FOR US TO BE ABLE TO DISCUSS THAT.
I DON'T AGAIN, IT'S NOT ABOUT SOMEONE AND I DON'T HAVE SOMEONE FOR THE POSITION.
BUT I'M JUST CONCERNED ABOUT THE THE WEIGHT OF THIS POSITION.
I'M NOT. MY QUESTION IS I JUST WANT TO KNOW WHAT WE'RE DOING COMING UP IN THE FUTURE.
HERE. ARE WE ARE YOU BRINGING BACK TO WORKSHOP A, A GUIDELINES ON PUTTING THIS INTERVIEW, THIS ONE POSITION THAT'S CURRENTLY OPEN IN THE POLICE PENSION INTO OUR INTERVIEW PROCESS.
WE WORKSHOP IT AND THEN VOTE ON THAT.
AND THEN WE COME BACK AND INTERVIEW THIS POSITION.
HOW DO WE I NEED SOME GUIDANCE ON THIS.
I DON'T KNOW WHAT WE'RE GOING TO DO.
I DON'T WANT TO MAKE THIS UP ON THE FLOOR.
SIT DOWN AND FIGURE OUT A GOOD WAY TO DEFER THIS.
CORRECT? I THINK THE IDEA HERE, GUYS, IS WE DON'T WANT TO EMBARRASS ANYBODY ELSE.
LET'S MAKE SURE WE HAVE A GOOD PROCESS.
WELL, I THINK I THINK DAVID'S MORE THAN THAT, THOUGH.
I THINK DAVID IS HE MENTIONED I DON'T WANT TO SPEAK FOR YOU, DAVID, BUT I WILL, THAT BUT IT'S WHAT YOU MENTIONED THAT WE DON'T WANT TO NOMINATE SOMEONE THAT'S NOT QUALIFIED.
I WOULD EXPAND ON THAT. WE DO BECAUSE WE ONLY GET TWO POSITION NOMINATIONS ON THIS BOARD.
I MEAN, MR. MAXWELL HAS A COUPLE BUT COUNCIL ONLY GETS TO WEIGH IN TWICE.
AND IT'S I THINK IT'S IMPORTANT THAT WE HAVE GOALS THAT WE UNDERSTAND WHAT THE CRITERIA ARE AND THAT WE APPOINT SOMEONE WHOSE POSITION IS GOING TO BE CONSISTENT WITH CITY GOALS, CITY GUIDELINES AND OUR POSITION ON THIS.
WE'VE DONE SO WELL WITH OUR OTHER APPOINTMENTS AT THE PARK BOARD, SO THAT SOUNDS GOOD TO ME.
IS THERE A SECOND I THINK JOHN PAUL SECOND THAT, ANY FURTHER DISCUSSION ON THAT.
ALL THOSE IN FAVOR? THAT IS UNANIMOUS, SCOTT.
WE WILL BE TALKING TO YOU IN THE FUTURE TO COMING UP.
ALL RIGHT, COUNCIL, WE'RE COMING UP TOWARDS THE END.
WE HAVE GONE THROUGH ALL OF THOSE.
THEY ARE ON OUR AGENDA AS OUTLINED THERE.
WE HAVE GONE THROUGH ALL OF OUR ITEMS. IT IS 6:34.
I PROJECTED 6:30 AND WE ARE ADJOURNED.
THANK YOU.
