THE BOARD DENIED THE REQUEST, PRIMARILY ON THE GROUNDS THAT THE LOT WERE SIMILAR IN SIZE WAS SIMILAR IN SIZE TO OTHER LOTS IN THE AREA, AS WELL AS TWO OF THE PROPOSED LOTS DEVIATED SUBSTANTIALLY FROM THE REQUIRED LOT STANDARDS.
THE BOARD ALSO OPINED THAT IT WAS MORE DESIRABLE TO HAVE LESS DENSITY IN THE AREA.
IN THIS REQUEST, THE APPLICANT IS ASKING FOR A VARIANCE FROM THE GALVESTON LAND REGULATIONS ARTICLE 3 RESIDENTIAL SINGLE FAMILY R1 ADDENDUM REGARDING MINIMUM STANDARDS FOR LOT DEPTH, IN ORDER TO DIVIDE ONE LOT INTO TWO LOTS.
PLEASE SEE ATTACHED SITE PLAN FOR A PROPOSED LOT RECONFIGURATION.

CAN THAT BE DISPLAYED? ALL RIGHT. SO YOU'LL SEE IF MY PROPOSED SUBDIVISION IS APPROVED, THEN MY LOT WILL LOOK VERY SIMILAR TO THE EXISTING SUBDIVISION ALONG WARREN DRIVE.
ADDITIONALLY, ALMOST ALL THE REST OF THE LOTS ALONG 103RD STREET, 17 OF THEM ARE 0.38 ACRE LOTS OF WHICH 0.2 IS BUILDABLE.
MY SUBDIVISION WILL RESULT IN TWO LOTS, EACH OF WHICH IS ALMOST THE SAME 0.19 ACRES BUILDABLE.
OF THE TWO LOTS, LOT TWO DOES NOT NEED A VARIANCE AT ALL.
LOT ONE I ONLY NEED THREE AND A HALF FEET.
THERE IS THE SUBDIVISION REQUIREMENTS IN THIS AREA ARE A REQUIRE A 100 FOOT DEPTH.
I ONLY HAVE 96 AND A HALF, SO FOR LACK OF THREE AND A HALF FEET, I WOULD NOT BE BEFORE YOU AT ALL.
AND THAT'S KIND OF MY PROPOSAL.

I MOVE TO APPROVE [INAUDIBLE] IT'S NOT APPROVAL YOU MOVE TO GRANT THE VARIANCE AND STATE WHAT CIRCUMSTANCE EXIST TO GRANT A VARIANCE FOR THE FOLLOWING REASONS.
THIS REQUEST FOR VARIANCE IS ROOTED IN SPECIAL CONDITIONS OF THE APPLICANT'S PROPERTY AND THAT HIS PROPERTY IS RULE NUMBER ONE IT'S ON A QUARTER LOT, SO HE MAY BRING THIS [INAUDIBLE] REQUEST FOR VARIANCE AND THE SHAPE OF HIS LOT IS MUCH LARGER THAN MOST OF THE LOTS AND THEN EXISTS IN THE OTHER PROPERTIES.
AND SO THAT WOULD BE THE SPECIAL CONDITION.
THE VARIANCE IS NOT CONTRARY TO THE PUBLIC INTEREST.
HE'S ONLY ASKING FOR THREE AND A HALF FEET THAT HE LACKS DEPTH WISE FOR THIS LOT.
THE VARIANCE WON'T HAVE A DETRIMENTAL IMPACT ON THE CURRENT OR FUTURE USE OF ADJACENT PROPERTIES, PUBLIC INFRASTRUCTURE OR SERVICES OR PUBLIC HEALTH SAFETY, MORALS AND GENERAL WELFARE OF THE COMMUNITY.
LET'S SEE THE DEGREE OF VARIANCE ALLOWED FROM THE LDR.
THE LAND DEVELOPMENT REGULATIONS IS THE LEASE THAT IS NECESSARY TO GRANT RELIEF.

HE'S JUST ASKING FOR THREE AND A HALF FEET.THERE'S NO EVIDENCE THAT THE VARIANCE WOULD BE USED TO CIRCUMVENT THE PROCEDURES AND STANDARDS OF THE LDR THAT COULD BE USED FOR THE SAME OR COMPARABLE EFFECT. BY GRANTING THIS VARIANCE, THE SPIRIT OF THE LDR IS OBSERVANCE AND SUBSTANTIAL JUSTICE IS DONE. THE LAND AND THE HIS PROPOSAL WON'T BE SIGNIFICANTLY DIFFERENT FROM ANY OTHER LAND DEVELOPMENTS THAT ARE CURRENTLY OUT THERE.
FOR THESE REASONS, I MOVE TO APPROVE THE REQUEST TO GRANT THE REQUEST.
