TO GET STARTED THE BACKGROUND OR PURPOSE OF THESE RULES, [00:05:02] THE STATE HAS LAWS THAT REQUIRE LOCAL GOVERNMENTS ALONG THE TEXAS GULF COAST TO ADOPT [NOISE] RULES AND REQUIREMENTS IN A PLAN, INSTEAD OF A REFERENCED DUNE PROTECTION AND BEACH ACCESS PLAN [NOISE]. THE GOAL OF THESE RULES IS TO CARE FOR THE MANAGEMENT AND USE OF THE PUBLIC BEACH, THE CARE AND PROTECTION OF SAND DUNES AND TO REDUCE PUBLIC EXPENDITURES FOR EROSION AND STORM DAMAGE LOSSES. I'VE HIGHLIGHTED OR EMPHASIZED THOSE LAST TWO BECAUSE THOSE ARE A LOT OF THE AIRPLANE THE PLANNING COMMISSION HAS WITH THE PERMITTING PROCESS COMES INTO PLAY. WE CAN SHARE THIS PRESENTATION IN THE AFTERNOON MEETING. THERE'S ALSO AN INTEGRATION RESPONSE PLAN, WHICH IS AN APPENDIX ATTACHED TO [NOISE] OVERALL IN-PROTECTION OF THE BEACH ACCESS PLAN. THIS WAS A SEPARATE INSTRUMENT TO GETTING BACK TO THAT THIRD BULLET POINT TO HELP GUIDE THE LOCAL GOVERNMENT IN RESPONSIBLE DEVELOPMENT THAT REDUCES PUBLIC EXPENDITURES FOR EROSION AND STORM DAMAGE LOSSES. [NOISE] THEY ARE FOR ANY AREA UP TO 1,000 FEET OF THE MEAN HIGH TIDE LINE OR SEAWARD OF THE FIRST PUBLIC ROAD, WHICHEVER DISTANCE IS GREATER. THERE ARE A COUPLE OF AREAS ON GALVESTON HARDWARE THAT MORE THAN A 1000 FEET WOULD APPLY, BUT IT'S PRETTY LIMITED. GENERALLY SPEAKING, IF YOU THINK ABOUT 1000 FEET FROM THE HIGH TIDE LINE THAT COVERS THEM AND IN SOME CASES, YES, THIS DOES EVEN APPLY TO LAND AREAS ON THE OTHER SIDE OF HIGHWAY 3005. OUR LOCAL PLAN DOES HAVE ONE EXEMPTION FOR THIS RULE, WHICH WOULD BE AREAS LANDWARD OF THE SEAWALL. HOUSES AND BUSINESSES ON THE LANDWARD SIDE OF THE SEAWALL DO NOT FOLLOW THIS CONSTRUCTION SO THAT THEY CAN GET PROCESSED. LET'S SEE EXACTLY WHERE IT WOULD [NOISE]. THEY REQUIRE AN APPLICANT TO NOTIFY NEIGHBORING PROPAGATORS OF A PUBLIC HEARING PROCESS IF THERE IS A MITIGATION PROJECT PROPOSED AND ASSOCIATED WITH CONSTRUCTION. WHEN SOMEONE'S BUILDING AND THEY'RE DOING ACTIVITIES THAT WILL HAVE ADVERSE EFFECTS TO DO, THEN, THEY'RE REQUIRED TO HAVE A MITIGATION PLAN AND THAT THE STATE'S REQUIRING [INAUDIBLE] WITH A PUBLIC HEARING PROCESS FOR THAT APPROVAL. [BACKGROUND] WHAT'S THE PROCESS? I WISH IT WAS FIVE EASY STEPS. THEY COULD TAKE A LITTLE LONGER, [NOISE] BUT FIRST OF ALL, THE PROCESS STARTS WITH, AGAIN, A PROPAGATOR OR THEIR DESIGNATED WILL TURN THAT APPLICATION INTO OUR OFFICE. THAT APPLICATION WILL BE AN APPLICATION FORM, CONSTRUCTION DRAWINGS, CURRENT PHOTOS OF THE SITE WHERE CONSTRUCTION IS OCCURRING. THERE MAY BE OTHER REQUIREMENTS OF THE BUILDING PRETTY CLOSE TO THE BEACH VIEW. THEY MAY NEED TO HAVE A CURRENT TOPOGRAPHIC SURVEY OR OTHER INSTRUMENT THAT EXPLAINS WHERE THE CONSTRUCTION WILL BE OCCURRING IN RELATION TO THE BEACH IN GENERAL. [NOISE] ONCE THEY SUBMIT THAT TO OUR OFFICE, WE REVIEW IT IF WE HAVE SUFFICIENT INFORMATION TO FORWARD ON TO THE GENERAL LAND OFFICE, WITHIN THE COMMENT, THEN WE WILL DO SO. [NOISE] THE GENERAL LAND OFFICE STAFF WILL HAVE BETWEEN 10-30 BUSINESS DAYS DEPENDING ON THE SCALE OF THE PROJECT TO REVIEW IT. IN SOME CASES, THEY MAY SEE SOMETHING THAT CITY STAFF DIDN'T CATCH, OR THEY MAY REQUEST FOR A LITTLE MORE SCRUPULOUS DETAILS, OR ADDITIONAL INFORMATION [NOISE] ON AN APPLICATION TO COMPLETE THEIR REVIEW. THAT WOULD RESTART BACK TO THE 30-DAY CLOCK. THEN, THE LAST STEP WOULD BE THE CITY EITHER [INAUDIBLE] TO THE ADMINISTRATOR THE APPLICATION TO REVIEW AND ISSUE IT RIGHT THEN AND THERE OR IF IT'S ONE THAT GOES TO THE PLANNING COMMISSION FOR REVIEW. [NOISE] THE CITY'S EROSION RESPONSE PLAN ALSO HAS HIGHER CONSTRUCTION STANDARDS FOR ANY KIND OF CONSTRUCTION OCCURRING IN LAND, WITH A VERY MUCH [INAUDIBLE] THE ENHANCED CONSTRUCTIONS AROUND THE AREA. THE GRADING MATERIAL THERE HAS ADDITIONAL CONSTRUCTION REQUIREMENTS BEYOND THAT DUNE CONSERVATION AREA. AS YOU CAN SEE FROM THIS EXAMPLE, THEY'RE 1000 FEET FROM THE HIGH TIDE. IT GOES WELL ACROSS THE HIGH BAY AND ENCOMPASSES THE LOTS IN THIS LAND ON THE LANDWARD SIDE OF [INAUDIBLE] AS WELL.
