Consider a motion to authorize the City to retain Denton, Navarro, Rocha & Bernal, P.C. as Special Counsel in the area of Ethics & Compliance to assist and represent the City of Galveston, Texas, as necessary.
Consider for approval of an Ordinance of the City of Galveston, Texas, amending "The Code of the City of Galveston 1982, as amended," Chapter 2, Article II, Division 5 relating to the management of City records; exercising the governing body's authority to demand any local government record of the City in private possession be provided to the City; authorizing the City Manager to petition the district court to determine the character of a document as a local government record upon the refusal to provide such document; declaring all communications made in official capacity, including electronic communications, are local governmental records pursuant to the Texas Local Government Records Act; making various findings and provisions related to the subject; and providing for an effective date.
Consider a motion pursuant to Texas Local Government Code Sec. 202.005 ("Right of Recovery") to demand and receive from The Galveston County Daily News, and/or any of its representatives, including, but not limited to John Wayne Ferguson, any and all local government records in private possession created or received by the local government, the removal of which was not authorized by law.
Consider a motion to authorize Denton, Navarro, Rocha & Bernal, P.C. as Special Counsel, pursuant to Article 2, Section 5 of The City Charter to take all necessary action to investigate, report, and pursue the facts and circumstances surrounding the unauthorized release and/or unauthorized removal of local governmental records from the City of Galveston and to pursue any and all internal, administrative, and/or legal action to do so and claims for damages, civil penalties, costs, and attorneys' fees.
